Do I have any recourse if a company uses my resume (as part of a Proposal) to me a requirement for a crucial position and gives me a contingent offer (based on whether they win the contract); then wins the contract and does not give the position as stipulated in the offer.

I was contacted by the recruiter who inquired whether I was still available. When I returned her

call she stated she had "jumped the gun" and they were possibly putting another candidate in the

position.

I feel like they did the old bait and switch with the government. Used the resume of the most

qualified person for the proposal, then put a lower paid person in place to save the company money?



Answer

Legally speaking, the matter would appear to reduce to whether this

contingent offer amounted to a legally enforceable contract under

Virginia law, and based upon the facts provided in this question,

they are insufficient to offer a reliable opinion (in my view).
