Please keep in mind that my response is just a general comment on your question, and not legal advice. I have answered based upon the law of the State of New Jersey where I practice; the laws in other states may be very different, and may result in very different outcomes. Your question and any response does NOT create an attorney-client relationship between you and this law firm. The exact details of your situation and things that you have not mentioned in your question can completely change the response I gave. You can not rely upon what I have written as legal advice, because I do not have all of the information that I need to advise you, I only have the very small amount of information that you put into your question. To get legal advice that you can rely on and use, please contact me directly.

can a codefendant testify against me in a criminal case for murder?

Question

can a codefendant testify against me in a criminal case for murder?

Answer

Yes, each defendant should have their own attorney.

Answer

Yes. Anybody could be flipped by the prosecution and offered a deal in exchange for their testimony against you.

There are rules regarding accomplice testimony, etc.

Answer

Most definitely. This is why the prosecution files charges against more than one defendant. Sooner or later, one defendant will work a deal with the prosecutor to testify against the other. The term of art for this is "turning state's evidence."

Stay in the U.S

You need to consult with an immigration attorney ASAP for an explanation of your options. For a free consultation, call me today at 904-371-3538 or email me at [email protected]/* */

Answer

At the Master Hearing you can request time to obtain legal counsel. The court should even provide a list of free or low cost legal service providers. You should not admit the charges until you have had an opportunity to speak with an attorney. Whether or not you have any chance of remaining in the United States depends on your personal situation.

Question

My friend was arrested but then let go without charges because he was not involved in the illegal activity that was going on. There was a task force involved in the arrests with several departments participating. After my friend was released without charges, an officer from the town that my friend lives in and where the crime took place contacted my friend's landlord (the crime was not commited on the landlord's property) and told him that my friend had been arrested. Is it legal for the police to do this?

Answer

Hello. In my opinion, this is improper and unprofessional behavior on behalf of the police officer. Your friend is presumed innocent, until proven guilty in a court of law. Your friend should take steps to have the arrest expunged from his record. He may want to lodge a complaint against the officer with the local police department. Your friend should seek legal counsel immediately.

Will be happy to discuss this further and in more detail.
