Question

I was in a same sex relationship and gave birth to twins through insemination. We have been separated for 5 years and she never adopted them or did anything legally for custody. She does pay child support through the state and has visitation every other weekend based on our own compromise. My question is this: I want to move out of state and she is threatening to take me to court to keep me here. Does she have a case? I would be moving to go to nursing school and better the lives of my children. Can I move?



Answer

Since Pennsylvania does not recognize same-sex unions of any kind and there is no Custody Order in effect, there would be no basis on which this individual could rely if she attempted to prevent you from leaving Pennsylvania.
