In 05 father signed power of attorney to his brother while he was sick. Now he has dimentia. As his legal son what rights do I have?
Answer
A power of attorney is only good as to the person to whom it has been given. AS the next of kin however, you may have standing to receive some information and make some decisions. In order to make sure that you don't run into any problems down the road, you should consult with an Elder Law attorney soon in order to fully understand your situation.
