My son was charged with indecency w/a child expose in dallas, texas, he is a good kid got sentenced
to 10 years probation. This took place because he was told by young lady that she was an age that
was false. It would seem that you should also be held accountable for lying/misrepresenting yourself for something that you are not, especially when someone elses life is at stake. Now, if that same minor committed murder they would be prosecuted as an adult - but as a minor the law says that a minor cannot consent to sex, sounds like a double standard. There are alot of good men who are suffering as a result of the deceit of a woman - would this make a good supreme court undertaking -
if not, what would you recommend in the defense of my son?
Answer
Since your son has received probation that means that he has been found guilty either through a plea bargain or a trial. This severely limits his ability to make the challenge you suggest to some sort of appeal. The other issue is whether there is any proof that the minor lied to him.
If you want to pursue this further, I suggest you discuss this with a criminal appellate attorney.
