If that is the exact language of the visitation, you either had a horrible lawyer or made the gigantic mistake of writing it without a lawyer, because the language is sloppy and imprecise and is designed to land two uncooperative parents in court again.
See a lawyer to determine if there even is a course of action. The agreement should have had specific language and doesn't, and that is likely only to be fixable by parental cooperation or by spending a lot of money to obtain lawyers and go back to court.

After a conviction, charges are not reduced because the matter is resolved by the plea of guilty. Your Constitutional Right to bear arms are not restored until after the passage of ten years from the date you are released from state custody or supervision. Simply, the ten years begin to run after your parole or probation is terminated. The expungement statute under which you pled only removes this conviction from the publics view and not from the inspection of governmental/law enforcement agencies. If you are arrested, after expunging your record of the conviction, for possession of a firearm, you can be charged with possession of a firearm by a convicted felon. An expungement does not prohibit the State from prosecuting you as such nor as an Habitual Offender if convicted of another felony within the ten year cleansing period.
You can petition the State of Louisiana for permission to purchase a hunting rifle and explain your situation. It is my guess that you will be denied because of the conviction but you can try.

The only thing I can suggest is that your ex refinance the car note in their name. If you are paying for the insurance, since you are on the note, you can not cancel otherwise that will trigger a whole host of other problems. Once the car is refinanced, then you can sign over the title, and cancel the insurance.

You need to make the Louisiana Judgment a Judgment of the State of Wisconsin. You do that by the rules of Wisconsin. After you get WI to recognize the LA judgment, it becomes the Judgment of WI and you can enforce it any way you wish. With the help of my attorney, I was able to work out a payment plan with the IRS and a loan modification to catch up on my mortgage company. During the divorce/bankruptcy process, I rented out of my primary residence and moved in with a relatives. This allowed me to save money and catch up on the owed child support. I thought things were looking up until the day the bankruptcy was granted. During the final hearing on the bankruptcy, the courted appointed trustee entered a motion to sale my residence which has a fair bit of equity. The judge said he would take the motion under consideration and rule on in 60 days. When I questioned my attorney on the basis or justification for the trustee selling the house when all creditors where essentially satisfied, he stated the trustee had made it clear that selling the house was the only way the trustee would receive he payment for his time/effort and since there are no other assets from which to recoup any fees. My attorney said trustee stands to gain a percentage of the equity and since the agreements are in place with the other debtors, he stands to gain alot. Can the trustee really do this? It seems terribly self-serving and rather like robbing peter?

I don't know as you provide no information. The relative lender says a personal loan was made. Well, is there some documentary proof of that? Your post does not indicate. Was a timely claim filed? If not, then the claim can be denied on this basis alone. If a timely claim was filed, the executor is free to accept, reject or compromise the claim. Assuming that there is documentary proof of the loan (a cancelled check with "loan" written in the memo line or a promissory note) then you can pay if there are assets.
But something is not right here. Claims must be filed within the time set forth in the notice to creditors. So why are funds disbursed? This should not be if the estate is still open. And this should not occur anyway. All claims are filed. Claims are paid if the estate has sufficient funds. Before anything else is disbursed to the heirs, the approval of the tax office must be obtained and there should be signed receipts and releases filed (this helps streamline the final accounting). Otherwise, the final accounting is filed and a confirmation hearing is held by the clerk or court, depending on the county. After the accounting is confirmed, then the funds or other assets are distributed to the heirs/beneficiaries.
So what you describe is not possible if the estate was properly administered. Either a timely claim was filed prior to distribution of the estate or it was not. If the claim was not timely that is the end of it. If, however, you improperly administered the estate and distributed assets before the time for claims ran out and if the claim was timely filed and if there are no other grounds for denying the claim, then you as an executor will be placed in the position of either asking the heirs to cough up money OR else you as executor will be held personally liable because you made an at risk distribution.
I hope its the former not the latter. I strongly suggest that you contact a probate attorney who practices in the county where the estate is pending to review what has happened here and to review the claim filed by the family member.

I have a child support case from New York (where I used to live) which was ordered by a support magistrate out of queens family court in 2010, however, immediately after that I moved to Texas where my daughter and ex wife have always lived. I had been paying her directly up until 2010 by depositing funds into her acct, 750.00 monthly. I lost my job in 2010 and couldn't deposit any more money for her, I was then summoned to court. In court I was give exactly 4 seconds by this judge which didn't even allow me to open my mouth and all of a sudden I was ordered to pay 1600 a month retro for years prior which automatically put me into 120k in arrears. I left in awe and didn't know what to do other than file for a modification which I did and the judge denied the motion. About a year after that while only paying my ex wife whatever I could because I couldn't get a job as I now had this child support issue hanging over my head, on my credit report and now one wanted to hire me especially in the field that I have worked all my life which is edible commodities. For the past several years I was sending as much as I could and all along while living in Texas I finally found a job in Houston and since November they have been taking out $2400 a month from my check which is $1600 for the support and 800 for the arrears. My ex wife is well off and doesn't need money, lives in a new home that I had built and drives a $125k Mercedes Benz vehicle. My point with that last sentence is that she sends me back the 800 bucks a month because she knows the arrears are erroneous. I want to get the NY family court out of this picture and out of my life because we don't live in NY we both live in Texas, her in Dallas and I in Houston. Besides that I just found out that my license has been suspended in NY since 2012 and I had no clue as I still have my NY license which expires in 2019 and after calling the courts they mentioned the fact that I have money judgements against me for this issue. You really need an attorney to assist you in this matter. There are plenty of Family Law Attorneys who have offices in both Houston and Dallas (Jurisdiction can be transferred to Dallas because that is where your child lives, among other requirements). there are advantages to having attorneys in both the area you reside and the location of the suit.

I would need to know more before giving a complete response. Generally, the rights of natural parents are always greater than those of grandparents. There is no such thing as "sole physical custody" - "custody" is the right to make decisions about children including health care, education, and religion, among other things. "Residence" or "Residential Possession" or "Residential Custody" is simply where the child lives primarily. You don't explain whether this arrangement is the result of a court order, an agreement, or otherwise. In a generic situation, the natural parents should be able to do whatever they want with their own children unless barred by court order (due to abuse, neglect, etc.). Hope this helps.

There is no violation for a creditor to call your cell phone unless you specifically told the creditor, in writing, not to call you on your cell phone. And if the creditor has a judgment against you they can seek to garnish your wages and raid your bank account.

A ticket is an allegation that someone violated the law, not a conviction. There are few things that prevent an allegation. If the accused denies the allegation, the prosecutor must prove the case. The officer being off duty, and waiting several days to make the allegation, can make it tougher for the prosecutor to make their case against the accused.

A couple of months ago, a client residing in Alabama purchased a vehicle from us at our dealership in Georgia and we did a loan for her through one of our banks. We mailed in all her paperwork for title processing to her local DMV and she's now calling us telling us that her daughter is actually driving the car and she's four hours away. This is a problem for 2 reasons: 1) The client needs to perform a local VIN inspection at her DMV where she resides in order to receive or transfer a tag. 2) The client has now just told me that her daughter is actually driving this vehicle and that her daughter lives 4 hours away, making it hard to get the VIN inspection at her DMV. The Mom is paying for the loan and insuring it, but this still makes me worry, as we are not trying to be part of a straw purchase.
Can someone please advise if there's any other precautionary steps we should take. Thanks!

First off, you need to realize that each question you post is completely disconnected from any previous questions you have posted or answers we have given. So I can only guess from this what you are referring to. Assuming you are the person I recently told they were asking local questions and suggested that they contact the local Family Court for answers: the answer to your current question is "No," it is not the same for all of California. As I told you earlier today, telephonic appearance rules and procedures are local matters. They are established by local rules that differ from county to county. And to make things even more challenging, almost every County allows each judge to set their own rules and procedures for telephonic appearances, submission of evidence and pretty much everything else to do with the nuts and bolts of a hearing. So, as I told you before, you need to contact the individual courtroom clerk or deputy if you can do that in your particular court. Otherwise you have to ask the people here: http://slocourts.net/self_help/family_law/facilitator_schedule. Written consent isn't really even enough to be safe. You need to go back to court for a modification of the custody and visitation order. "Move-away" proceedings are tricky things. You have a good case for one, but they are never slam-dunk winners for either parent. I cannot recommend strongly enough that you retain counsel to assist you.

Do you have anyt documents in writing from your friend; any receipts, cancelled checks, written acknowledgement of loan, etc. I would start an action now if you figure you wnat to preserve your rights; but beware, you can not get blood from stone. Payments were made through their bankruptcy for about 2 years until they surrendered it as collateral and I then pick the payments back up and have almost paid it off. Now I am being sued for the payments made on vehicle through bankruptcy even though that person chose to keep the car on the bankruptcy until they saw that there was not going to be a reconciliation. Now they are claiming I owe them the money back when there was never an agreement that the payments made by them was any type of loan.

That will never happen under current law. The whole point is that so long as your ex is using public dollars to support your child, the government wants to know that both parents are doing their part to provide for the child. The only way around you having to pay is if you yourself were on TANF as well. Your ex cannot ask for public assistance and then refuse help from you. The law simply does not work that way.
Support will be established based on your income and the Washington State Child Support Schedule Worksheets. Search the internet and you will see the worksheets and can get an idea of what your support will be.

This is really a financial question and not a legal matter.
You need to examine the loan terms. Obviously, your current payment does not include paying down the principal loan balance. Is the payment calculated as an interest only payment? If so, that is why your loan balance has not decreased.

Did the insurance company pay fair market value? If so, that's all that your daughter is entitled to. The fair market value - not more, not less. Unfortunately the second you drive the car off the dealer's lot it depreciates. Hence, unless your daughter had purchased a GAP insurance shoe and you are SOL - sorry for being crude.

The prosecutor could treat you as an adult, which means you would probably be facing at a minimum boot camp (90-120 days, plsu 4-5 years on probation). If you are treated as a minor it will probably mean probation. Would like to assist in trying to answer your question; but, not sure what your questions is. A little more information about your situation would be helpful as well.
How do you set up a home recording studio?
well there's several ways to go about doing this, and of course money is gonna be required, the more u can pay, the better the equipment USUALLY is.
First off you can do it Analog or Digital, Digital is more common these days and easier to work with i think. If you want to use a computer you can download a multitrack recording and editing program such as Cool Edit Pro or whatever else you can find. You can download demos of different programs and find one that you like best off of Kazaa or Limewire.
Depending on what kind of computer you got or soundcard, you may want to invest in a new soundcard like a Delta 1010LT off of musiciansfriend.com or you could buy an external device like a Firewire input. From here if you only want to use one mic, you can just go right through there. But if you want to mic several instruments or whatever, and adjust their volumes, then i'd get a mixer. They come with different numbers of channels depending on how much you want to spend or how many mics your going to use simultaneously.
The setup I use works pretty good, I have the Delta 1010LT installed in the back of my computer and I have a Peavey PV-14 mixer connected to it. I use cool edit pro for my recording program.
As far as microphones go, you needa know the difference between condenser microphones and Dynamic microphones. Dynamic microphones are usually cheaper, simpler and easier. But they may not sound as good for you. They use a diaphragm that requires no power to pick up the audio signal. Condenser microphones require phantom power, if you are gonna buy a mixer and use condenser microphones with it, make sure the mixer can produce the phantom power required by the microphone. Condenser microphones also have a front, unlike the dynamics, and pick up the audio best on that part. Make sure u get mics that can pick up the highs or lows of the instrument they'll be used on. As far as micing positions go....there are infinite ways to do them. Experiment till ya get what ya like, most people don't put them right in front of the speaker but off to the side a little bit.

Even then, the birth certificate won't be changed until someone obtains a certified copy of the court order and pays a fee to teh Department of Vital Statistics in Austin.

A ward or protectee may either cancel the appointment of an attorney in fact (power or attorney) or they may petition the probate court to terminate the guardianship. In one the person merely has top make the cancellation public. In the latter, they must show that they posees no need for the state to supersde their decisions, and that they are competnet and have the capacity. to hanlde their own care and affairs. These are vey seimple explnantions of what can be technical criteria. How is a battery leakage test conducted?
Set your voltmeter to a low DC Volt range. Connect the negative lead to the battery's negative post. Then move the meter's positive lead across the top and sides of the battery case. If some voltage is read on the meter, current is leaking out of the battery. I'm trying to get a divorce, my husband took me out of the house three weeks ago, he wants to give back the few things he gave me during the time of our marriage as the cell phone. He threatened me saying he can accuse me of stealing him. I changed my phone number, he is still trying to have some communication with me through my e-mail. I try not to answer him because on his e-mails he threat me insults me sometimes, and other times he is extra quiet in the divorce papers he states things that are not true or omitted important information also for not taking responsibility . I'm confused because he knows I have no money to pay a lawyer and he continues to bother me.

If you cannot find a divorce lawyer or get legal aid (Utah Legal Services) then get the court to order mediation and see what can be done there to resolve the problems. You are entitled to all of your property, half of all of the property you and your husband acquired together, possibly alimony and child support if you have children.
You will have to go to court and prepare papers for the court to read about your issues. You may be able to find a service that will help prepare the paper work, but are not lawyers.
