If you tell her to leave and she refuses, you should be able to simply have the police remove her without any sort of Judgment, as she can't show any legal right to be there (such as a lease). Still, police love to tell people, "This is a civil matter," and they very often refuse to remove squatters who have no right to be in a property. It is not the law, but the police do it all the time. Your best bet (if she refuses to leave) may be to go ahead and file for an eviction in the local city court or justice of the peace court having jurisdiction over the property. Bring proof of your ownership of the property (if you have it) when you file and go to trial.

At age 18 I got my drivers license, and started driving her cars. She would have me drive and run errands. 5 yrs later in Oct. 2003, I was out on an errand for her (she was with me) and got in an car accident. I was given a ticket for failure to yeild. No one was injured and Both the other driver and myself drove off after the police said we were free to leave. I went and paid the ticket, I thought all was fine. Shortly after this I got married, had a baby and moved to another town. Then in 2006, police served me with papers from the other drivers insurance company saying they had a judement against me for damages done to his dodge neon in the amount of $15,000. And that they were supspending my drivers license until it was paid. I called the lawyer handling the case and asked why this was happening and he informed me that the insurance on the car didn't cover anyone under the age of 25 and I was only 23 at the time. I wasn't at all aware of this fact. I had been driving her around and running her errands for years, She had insurance. Why she had that restriction I don't know, considering doing the driving was part of my stay/job. Anyway my husband and I seperated, then divorced and I could barely afford groceries let alone that judgement. In 2008 I got remarried. In 2009 I found out I was pregnant with my 2nd child. So my 2nd (and current) husband rejoined the military to support all 4 of us. In 2010, We were (and still are at the moment) stationed in Colorado, and my husband was deployed to Iraq and I needed my license. So I went to the DMV and was told to get intouch with the lawyer again, I did. I started making small payments (all that I could afford). I got my license back. We then started having money problems shortly after him returning home from deployment, so I was unable to make further payments. The lawyer understood and didn't persue the issue. But Last week I recieved a letter in the mail stating the previous lawyer retired and his cases were being taken over by another firm. They came across my file and were persuing this issue. In the letter, They did acknowledge the $900 I had already paid, but had an incorrect statement ( they said the insurance company started the judgement in 2008, which is false, I was served with papers in 2006, 3yrs after the accident) AND since I stopped payments and wasn't currently paying anything they added on additional fees, so now I owe them $19,000. And they were resuspending my drivers license until I paid it off OR until I started payments. But the small payments I was making to the previous lawyer was no longer acceptable, the payments would now need to be larger. We are a low rank military family with 2 kids. We already have bills that we struggle to pay. There is no way that I will be able to pay that. What can I do?? With my husband choosing to stay career military, we have the possibility/probability of moving anywhere at anytime. Plus he does get deployed every so often. (He's already had 3 overseas deployments) so I very much need my license. Along with the issue that we already have too much debt. We've been considering chapter 7 for everything, So my question is Can I file this judgement on chapter 7 b.r. and have this debt wiped clean, and have the suspension lifted??

You have so many issues in your question; obtain the services of a probate litigation attorney to begin to sort these matters out and enforce your rights as the beneficary of your father's estate, and bring litigation against the family members who are taking advantage of you. Aug 3rd,he was taken to medical west er where it was confirmed it was lithium toxicity-2.3 level. Aug 8th after being off lithium since the 1st was transported to Trinity psychiatric unit and was released aug 16th. was given the order of not to resume lithium and follow up with Western mental health Aug 20 @9:30. At the western app he was instructed to resume taking lithium at the prescribed dosage. Western never did a follow up lithium level blood work before He begun retaking lithium on Aug 20th. Aug 24th the symptoms retunrned: vomiting, diarrhea ,confusion,and weakness. When new symptoms begun Aug25th such as memory loss, incoordination of arms and legs and wasnt eating or drinking, and couldnt move body at all He was taking back to medical west er. After 12hrs in er he was admitted with lithium level triple the amount it should have been and he was remitted to hospital. By 4pm on aug 26th he couldnt talk and by 27th mri showed brain swelling with fluid. he had 2 dialysis treatments to lower lithium level and on Aug 28th was put in icu and sedated to coma like state. Sept 8th was transported to trinity long term care unit till sept 28th when he was transported back to medical west rehab unit till he was able to be transported to birmingham nursing rehab home oct 17th. he was able to come home dec 22, 2012. He has permanent neruologic damages that has him unable to walk, unable to be understood when speaking, eating,drinking,swallowing,taking care of personal needs-such as getting up out of bed,cleanoing up after bowel movements, taking bath/showering, feeding himself, he is unable to do all he could do himself before the 24th of aug. he has to have 24/7 care in which I his exwife/roomate provides everything for him and his health.
I think western mental health failed to monitor his lithium level especially being in hospital from aug3 to the 15th for toxicity and instructing him to resume taking the same dosage of lithium as before toxicity and not checking his current that day lithium level.

Now, a few months later, I had a bill in my mailbox for papers that I have been receiving up to this point for $75. However, the papers stopped being delivered a couple weeks in, and we never asked, signed for, or knew that we would be reciving any papers at all from the charity we donated to. My boyfriend did point out that there has been a newspaper being delivered to the first floor that no one had even receiving, but it had no name on it nor did I even think it was mine.

Actually it sounds more like some charity that may have tried to raise money by giving out "teaser" subscriptions, but let's assume what you say is correct. You should have a record of the "donation" and the terms and conditions of the "subscription". If you did not receive that you need to get a copy. If you have a copy you need to read it. That's most likely where your obligations would be spelled out, and if you had the right to stop delivery whether you have any proof. You may need to take a trip to the paper's business office to straighten this out and if they won't you can tell them they can assume you will never ever subscribe to their paper ever again..... For $75 you'd spend at least as much for an attorney even to write a letter on your behalf.....but don't let it go unpaid because they can report this to the credit agencies....and you don't want to get a bad credit report over a $75 bill.

Depends on the "product". Generally the only laws are those of supply and demand unless there is some public regulation of the pricing (such as utility rates....), or unless the manufacturer has a contract that prohibits true "resellers" from jacking up prices (normally price "fixing" is not allowed unless we're talking true distributors and/or resellers), or it's otherwise illegal (such as "ticket scalping"). However, if the commission structure is based on price, then whatever the price is should be the basis for the commission subject to whatever limitations there may be in the commission agreement.

I've seen this lots of times. CPS places a child under a "Plan of Service" agreement and then kind of disappears. It really leaves care givers in limbo.
I suggest you talk with a family law attorney in your area about a Suit Affecting Parent-Child Relationship. Filing this suit can get you temporary conservatorship of the child (so you can try to add her to your insurance) and then permanent conservatorship when the time for the parents to respond to the suit has passed or they have signed an agreed order. These kinds of orders can provide not only for conservatorship of the child but also for child support and visitation.
I am not aware of self help resources for this kind of thing and you really don't want to try doing it yourself anyway.
I suppose you could just call CPS and tell them you are going to give the child back to her parents if you don't get some help. I've never been able to get a client to try that approach and I'm not really recommending it - it's just kind of interesting to think about.

A Customer brought me his laptop to be serviced (first, I was to transfer data from Toshiba laptop to a usb flash-drive, I did this for the amount of $40.00.
The LCD screen wasn't lighting up, I told him I could repair it for $75.00 in parts, $50.00 installation.
I ordered the parts, Installed them, the machine functioned properly, the customer was happy he took his laptop home.
He returned it to me Feb 18th stating the screen was going off and on intermittently along with a few other scenarios.
After examining the machine it is my opinion the integrated graphics card device is malfunctioning causing this issue and was a direct result in the malfunctioning parts that was replaced in the beginning.
I explained to the customer I had know way of knowing this in the beginning that it can be common for the inverter in a laptop to go bad.
Now he wants a refund or he's going to sue me.
His out of expenses was $125.00

This is business, and time you spend screwing around with theis guy is time you can't spend on something that makes you money. Decide what it's worth to you to make this guy go away and make him the offer.
As Ms Sledziewski suggested, you should have some sort of a signed agreement about warranties. Perhaps a statement on the service ticket would do the trick. See what other businessmen do - guys like dry cleaners, pawn shops, other computer fixit shops, small engine repair guys, etc. Good luck.

The worst thing that you can do is to try and fix something that already has major errors without seeing a lawyer.
Bear in mind that while a clerk may tell you when you have a form missing, they can't tell you if you are doing everything else in a way that will prevent future problems. For a couple hundred dollars you could get a lawyer to not only draft what you need, but to review the rest of what you did (and still need to do) and be sure that you haven't overlooked things the court may approve but may cause you headaches later.
Probate law is far more than forms and there are choices to make. Making the right ones, for example, can get a person an year's exemption on property tax versus not getting one (just to cite one thing I ran into when looking at someone else's paperwork) and the clerks do not tell you THOSE type errors.

I agree with my colleagues. The issue is your wife's, not yours. Your duty, since the process server dropped off the papers, is to send them to your wife and suggest that she get local counsel. She, through her attorney, can object to service.
What you should have done is told your son or anyone else that your wife does not live there and refused service.
I suppose that you can always call the opposing lawyer and advise them, but it will mean nothing. Your wife is the one who must file something with the court objecting to service.
I don't know what she was sued for, but ultimately, objecting to service is only going to delay the inevitable. If it was for a debt, she should consider resolving it, but she should only do that after consulting a lawyer.

If the creditor was made aware of the bankruptcy, they were nto to take more garnisments. (assuming yrou bankruptcy wa shandled correctly) so you can demand and then sue to have the funds recovered. You will also need to file an objection to the present garnishment in the court from which the garnishment comes. You will likley need to have legal counsel do this for you.

I assume your question is asking whether there's a MINIMUM distance between trespass signs such that someone illegally on your property can't claim that they didn't see a sign. Here's the deal -- trespass signs do not carry any legal weight. No laws have been passed (that I'm aware of) which states that it is easier or harder to prosecute (criminally or in civil court) someone because a certain number of no trespass signs were placed a certain number of feet or yards apart.
Trespass occurs if someone comes on your property (or causes another person or object to come on your property) without your permission. Period. If your lot is fenced and gated at all entry points, that in and of itself is enough to put the world on notice that it is private property and to keep out. The addition of a few no trespass signs only reinforces the notion. No specific number required.

Your opportunity to oppose on the basis of needing time for additional discovery was when your opposition was due - back on July 11. Furthermore, the timeline for motions for summary judgment were changed many years ago to require the motion to be filed 75 days before the hearing, thus allowing a large amount of time to conduct discovery before the opposition is due 14 days before the hearing. This has virtually eliminated "need for discovery" as a grounds for denial of summary judgment except where the moving party has refused to respond or has otherwise blocked discovery promptly issued by the responding party in the 61 days between when the motion is filed and the opposition is due or earlier in the case. So unless you promptly issued discovery requests when you received the motion and there has been some barrier to completing your discovery between then and now, AND you have some excuse for not filing on the 11th if you needed further discovery, there is nothing you can file tomorrow that will do any good. Your ONLY other hope is to hire an attorney tomorrow morning who is willing to go in ex parte and ask for a continuance of the summary judgment hearing in the interests of justice so that he or she can prepare and participate in the case. I give you less than a 50/50 chance on that one.
