Question

One more question it might kind of dumb but here it goes. On the toxicoligy paper it has my name missed spelled can i go in to court and say that i dont know who that is thats not my name.

Answer

Nice try but no. Clerical errors like that won't save you automatically. Could it be an issue? Depends on ALL the facts.

You need a good criminal defense attorney. I'd strongly suggest you find someone who focuses on criminal law and who routinely practices in the court where this case will be heard.

Please pardon any typos - posted via mobile device.

Answer

I'll bet it has the correct case number on it. As with Mr. Dane, I recommend you hire an experienced defense attorney that actually knows what to do in your defense.

Answer

After doing about 1000 DUI's, I look for mistakes and problems with the prosecution's case. However, 1 minor mistake alone will generally not be enough to make an entire case go away. That being said, I like every single mistake law enforcement makes, because it builds a defense. I wish you well....David
