I was awarded the marital home in my divorce of 2008.I have since learned that my name is not on the mortgage note. I want to assume the mortgage and get my ex's name off the mortgage but the bank says it's not assumable. Do I have any legal right to assume the mortgage under Michigan law?



Answer

No. You take the title with the bank lien on it. The bank will hold your ex responsible for the payment. It is up to him to get his name off the lien. This is not unfair as when you got the home, you should have known the equity in it. What you can do is get an order that will notify you if your ex fails to meet the payment obligation on the mortgage. That way, you can protect your equity by paying the note.

I am a CDL driver and was hired to driver for a company. By law I was required to take a pre employment drug screen. I completed the drug screen. Few days later I was told by employer to attend orientation, which I did. About a week later I went out on my first route.

I only worked for this company 3 days due to being told I'd be back by a certain date and was not. I came back to the terminal with the truck and was told I had to make another delivery. I refused, I was then terminated.

Now, several weeks later I'm being told I tested positive on my pre employment drug screen.

What options do I have? The company hired me and allowed me to drive a 18 wheeler before they knew test results.

I would really appreciate anyones help in this matter.

What are you asking? You have the right to be paid for the work you did but you have no right to keep the job. Texas is an at-will employment state and failing a drug test is a very good reason not to hire someone to drive a big rig.

Good for her! Co-signing is ALWAYS a bad deal for the co-signer. What this probably means is that the car was "spotted" to you - that is given to you with the hope that all would be well and you would be approved for the loan. Well, you are not going to be approved. Your options now are: (a) find someone else who is dumb enough to co-sign because there is a good chance that you will default on the loan; (2) find another way to come up with funds for the car (either make a larger down payment or get another lender who does not require a co-signer); (3) give the car back and get a less expensive car that will not require you to have a co-signer; or (4) just give the car back.
