Not likely. In almost all cases, only the parents are responsible for child support, and only their income is considered when setting the amount. This would be true even if you did stay together. Your income would only be relevant to a determination of his taxation bracket (if your income throws him into a higher/lower tax bracket).

The court's minute order was filed later that same day reflecting the Judge's order asking me to come in, but the court clerk never mailed me a copy of the order and the court's file doesnt have a Proof of service, which further proves that I wasn't served with the order.

If I would've filed a Motion For Reconsideration Re: February 19, 2013 Court Order, the next day (Wednesday, 2/20/13) early in the morning when the court opens & before the continued hearing, would that have moot the judge's order from the previous day, so that I wouldn't have to appear later on at the continued hearing that same day (Wednesday 2/20/13)?

My Motion For Reconsideration would've been based on Different Facts, that I was unable to introduce as evidence at the OSC hearing cause the judge repeatedly interrupted me.

Since you had appeared at the hearing, you had notice of the order. Service of the paper copy upon you is unnecessary for the order to be effective. Note also that you were likely not "asked" to appear the next day -- you were ordered to do so. Your failure to appear likely constitutes violation of the court order, and contempt of court.

Filing papers the morning of 2/20/13 would not have nullified the order. The only thing that would have altered the order of 2/19/13 is a subsequent order that modifies or replaces what the judge decided on 2/19/13.

The fact that the judge interrupted you also means nothing. Judges cut lawyers and parties off all the time. It's a fact of life in a justice system where the courts simply have too many cases to handle.

It sounds to me like you need to hire a lawyer. There is a strong possibility that you are doing yourself more harm than good. Indeed, your question strongly suggests you lack the basic knowledge of court procedure to effectively represent yourself.

I agree with Mr. Perry. There are several points I'd like to add:

1. It's hard to imagine a basis for reconsidering an order to continue a hearing to the next day and telling you to appear in person.

2. Moving for reconsideration does not "moot" a court order. It asks the court to reconsider that order. The order remains in effect unless and until the court changes it. So even if you had filed a motion before court that morning you would still have had to appear.

3. If the court ruled against you on the merits of the OSC, you might be able to seek reconsideration of that ruling -- but only if you could show the court new and different facts and/or new and different law.

4. "New and different" means something you could not reasonably have included in your papers the first time around. You haven't said whether you filed papers ahead of the OSC or not. That is the way to get your evidence and argument in front of the judge. You are not supposed to just show up at the hearing (whether by phone or in person) and start talking. If you didn't file the papers you were supposed to file, then factual and legal arguments which should have been in those papers will not qualify as "new and different" now.

As Mr. Perry said, you need a lawyer right away.

As I understand it there's a five year lookback provision for Medicaid. If you were to divest yourself of this property today and give the money away it'd take five years before you could apply for medicaid. Also, to qualify for that sort of benefit you pretty much have to be dead broke too. I do not know whether there's a claw back provision either-that is, say you sold your house and gave the money to your kids and then went into a nursing home, whether the government would want the money back from your kids.

Assuming you have not been convicted of anything else, then the answer is probably. I say probably and not definitely because it depends on whether the charge was amended on the domestic battery. A domestic is also a simple battery, but a simple battery is not necessarily a domestic battery. It makes a difference because a domestic battery can never be sealed or expunged even if adjudication was withheld. After you have completed everything, you should talk to an attorney to see if you are eligible.

It would require a review of the deeds and the subdivision documentation to give you a conclusive answer, but chances are very good that the easement you received over the front parcel was "non-exclusive." If so, the front owner did, indeed, have the right to grant her an easement in the same location. That does not, however, give her the right to gate the easement or damage your curb or driveway. An action for trespass and possibly surcharge of the easement would probably be successful on those issues.

I would say "overburden" rather than surcharge, but otherwise I agree with Mr. McCormick. Nevertheless, in imagining the scenario without actually seeing the driveways or any map, it seems likely to me that the neighbor may be using, not only the portion which lies on the easement proper, but also part of the driveway that is on your own lot. The neighbor cannot do this without obtaining an easement from you, because you are the owner of the underlying land from the boundary on back. Does this make sense? In other words, to get to the back of the neighboring property, doesn't the neighbor have to use at least some portion of the driveway that lies on YOUR land?

In 2007, I purchased my home. Before I purchased the home, I had put a contract on the property which I was told by the owner was heading toward foreclosure. A short time later, my realtor told me that the property had foreclosed and was purchased by a developer. However, the developer was willing to sell it to me at the same price I was going to buy it from the homeowner. I decided to go ahead with purchasing it from the developer. My question is, if I already had a contract on the property and was told that it was not in foreclosure yet, was it illegal that the developer was able to purchase property right under me? If the house went into foreclosure while I had a contract on it, shouldn't I have been informed and allowed the opportunity to purchase the property as a foreclosure myself?

A foreclosure auction is open to the public, advertised in the paper and generally held on the courthouse steps. Only people present with the required deposit amount can bid. The lender controls the process, not the homeowner seller. A homeowner has no control over the foreclosure auction or bids and cannot interject another person's bid or offer, even if s/he had lined up a buyer already. It is possible that a buyer in your situation might have a breach of contract claim against the seller but this does not help get the property after it has been sold. Also, a buyer would need to press any claims within the time required by the statute of limitations. Buyers are wise to monitor the paper and/or court docket if they know or suspect a property might be headed to auction.

Then you state that another buyer with whom you were in contract bought out the property and made the same property available for your purchase at the same price. That depends. A creditor can only execute against the assets of persons who are judgment debtors. However the sheriff or Special Civil Part officers use the SSAN of the debtor to locate assets. So, if you have used your own SSAN on the business bank account, you might find that a levy has been placed against it for a personal judgment. If you can prove to the judge that the assets are not personal assets, the levy might be lifted. However, if the account if for a single member LLC, you will have a hard time convincing a judge that the funds should not be turned over.

Later, Mickey is playing games with his friends, including his delinquent elder brother Sammy and his special friend Linds (Kids Games). He introduces Eddie to Linda and they become a gang of three. But Eddie's mother has found out about his friendship with Mickey and the association with his birth mother. In her insecurity she tries to convince her husband to move away from the area, resistant at first he agrees when Eddie's friendship with Mickey leads him into minor trouble with the police. When Eddie comes round to say goodbye to Mickey, Mrs Johnstone gives him a locket with a picture of herself and Mickey inside, and makes a pact with Eddie to keep it their secret. When the Lyons depart, both young boys are sad and lonely at being parted (Long Sunday Afternoon/My Friend).
Mrs Johnstone and the other tennants of her street receive letters informing them the street is to be torn down and they are to be rehoused in a new council estate bordering on the countryside. She is overjoyed at the chance of a fresh new start in a better environment for her children (Bright New Day).
ACT II
Settled in her new home, life has improved for Mrs Johnstone. She even has a new suitor who takes her dancing (Marilyn Monroe). The story has moved on another seven years, Mickey and Linda are now 14, Sammy 16. Linda would like to be Mickey's girlfriend but Mickey is bashful and embarrassed and doesn't know how to tell her he feels the same. Edward, now at a private boarding school, is suspended for swearing at a teacher in refusing to give up the locket he always wears. At home, Mrs Lyons in angry that he has been suspended and wants to know what is in the locket and where it came from. She takes it from him, and demands to know why there is a picture of him and Mr Johnstone inside. Edward is confused and explains the boy inside is Mickey, not him, but will say no more. The narrator reminds us of what she has hidden (Shoes Upon the Table).
Now at home, Edward and Mickey cross paths. At first they don't recognise each other and each is envious of some aspect of the others demeanour (That Guy). But soon they realise and are overjoyed to have found each other again. Together with Linda, for a happy time they become inseperable again. More time passes, having left school Mickey has got a job in a factory and Edward is about to head off to University. He does not want to leave his friends again, particularly this time Linda, whom he realises he is falling in love with. But true to his friendship for Mickey, who he knows loves her too, he tells Linda that she and Mickey belong together whilst hinting at how he would trat her (I'm Not Saying a Word). Edward then finally persuades the bashful Mickey to admit his true feelings to Linda and they go off together.
A few months later Mickey tells his mother that Linda is pregnant. She gives her blessing for their marriage and agrees that they should both live with her. But their happiness is soon interrupted when cut-backs at the factory lead to Mickey losing his job ([Take a Letter] Miss Jones). When Edward returns home for Christmas he wants to celebrate with his friends who had promised to arrange a party, but Mickey is broke and angry over his inability to find work. Edward offers him money but this angers Mickey more, telling his friend that his life of privilege has kept him a child. They part angrily. Edward meets Linda and professes his love for her. She tells him she has always loved him in a way, but now she is married to Mickey. Desperate to make some money to support his wife and child, Mickey is tempted by his brother Sammy to assist him in a robbery. But it all goes wrong, Sammy shoots someone, but it is Mickey who is caught and imprisoned.
In prison, Mickey sinks into a fit of depression, and has to be prescribed pills to keep him calm. Mrs Johnstone explains the agony he is going through (Marilyn Monroe). Mickey is released after five years with time off for good behaviour. But by now he is totally dependant on the pills, he cannot give them up, even though they leave him morose and lethargic. Linda prevails upon their friendship with Eddie, now a councillor, to find them a home and a job for Mickey, hoping that a new start in life will help him recover. But Mickey realises where the largesse has come from, and becomes even more depressed and angry that he cannot provide these things for himself. Linda, distressed and lonely, turns to Edward for emotional support (Light Romance).
Mrs. Lyons, whose insecurity has blossomed into irrational hatred for the Johnstones, finds Mickey at work and informs him of Linda and Edward. It is the final straw for Mickey, who takes a gun and rushes off to the council chambers is search of Edward. The Narrator reminds us of the dire prophecy(Shoes Upon the Table/Madman). Mickey accuses Edward of owning everything he thought was his, including Linda and possibly even his child. The police arrive and order Mickey to put down the gun. Mrs. Johnstone and Linda arrive on the scene and beg Mickey to surrender, but he is beyond reason. In desperation Mrs. Johnstone tells Mickey he can't kill Eddie because he is his twin (whom he had always been told had died at birth). This only drives Mickey's jealousy beyond the breaking point, he asks why it was Edward and not him that she gave away. With a final cry of pain he shoots Edward, and is in turn shot by the police. As the prophecy foretold, both twins died together, shortly after discovering the truth.
Mrs Lyons arrives to find her son dead, and Mrs Johnstone is distraught at losing both boys (Tell Me Its Not True), and the story ends where it started.

However, usually the person receiving care has to qualify financially to have Medicaid pay for this type of care. The senior can't have any assets to qualify. They can take your property, garnish your wages, levy your bank account, put a lien on real estate in your name and make you go to go to answer questions unde oath about your income and assets (and if you don't go you can be arrested for contempt of court). They can also subpoena your records once a case is filed against you although you can object in certain cases. It would do no good if a person or company had a judgment against you and the person or company could not collect on it using the power of the court to enforce it.

Of course they discovered the fraud, and know you were working, your records are all computerized and cross checked, just for that purpose.

When charged with any crime, the proper questions are, can any evidence obtained be used against you, can you be convicted, and what can you do? A little free advice: exercise the 5th Amendment right to SHUT UP and do NOT talk to police or anyone about the case except with and through an attorney.

So you don't have a written agreement? If so, that was unfortunate. Ultimately, if the don't complete the project and put a lien on the property you will have to sue for breach of contract and to remove the lien. First of all the good news - you have no problem at all. ALWAYS ignore ignorant ex's when they make verbal threats about support. Until and unless he files a case, you have NOTHING to even think about. The fact that he is talking and not filing something is good news. IF he files something, hire counsel.

Moving in with a girlfriend and choosing to support her and not his kids (if he ever filkes anything) will tell the judge he is a jerk, as that is not a reason to alter support. In fact it could boomerang as you'd have a case pending in which to seek an increase.

So ignore him. As you already obviously know, he's a loser and he's not very smart.

By asking this question, I assume that you are alive and that you wish to file your will with the estates division of the court for safekeeping. There are some counties in North Carolina that allow you to do this for a small fee ($10 but you need to check with the county in which you are registering both to see if they do this and confirm the fee).

Before registering your will, you need to assess your circumstances. I usually do not recommend that people register their wills if they are young. The reason is that many things can happen - either they can get married or divorced or have/adopt children or even move to another state. As it is not possible to predict, it is probably better for such individuals to keep their will in a fireproof safe or safe deposit box.

If you are more advanced in years and it is unlikely that you will be moving out of state or having or adopting children, then go ahead and file if your county permits it. Make sure that you give copies of a receipt given to by the clerk of court to those folks who are named as the executors of your will so that they will know that you have a will and that it is on file. It may also be helpful for you to make copies of the will and give those to the executor as well as keep one for yourself. If you then want to make any changes, know that your will would be invalidated to an extent and you will have to file any new will or codicil with the estates division.

Not sure what you mean by the judge signing off in a month, but if you are talking about a final accounting and an order for final distribution, then that is when you should receive whatever you are supposed to receive under the will. You should contact the attorney for the estate and make sure you receive papers that are being filed so you can have a better idea of what is going on. You can also ask the lawyer for the estate when you are going to receive the distribution. I don't think a preliminary distribution is sensible if they are close to a final distribution next month.

The purpose, as explained to be by counsel, is to make these records admissable in court should a dispute arise.

Hello. As I see it, your question has two components. First, what form of documentation / retention of original data is customary and reasonable for a licensed land surveyor in this state. That unfortunately an attorney is ill suited to answer and really is better answered by your peers in the field. Second, the legal question as to whether electronically created field notes, etc. are admissible. Yes, so long as your records are kept in the ordinary course of business, made at or near the time of data collection, etc. and you can certify them as such, I don't see why one would have any problem with authenticity or admissibility under the rules of evidence in this state.

If your CA employer has at least 5 employees, they can not fire you because you are pregnant, must allow you to continue working as long as you are able, must 'reasonably' accommodate your disability, must allow up to 4 months of unpaid pregnancy leave under FEHA, and return you to the same or an equivalent job upon return to work, with accrued benefits. That would include the same shift to accommodate your needs.

If your CA employer has at least 50 employees, and you are employed for at least 12 months, have at least 1,250 hours worked in the 12 months prior to the leave, then you would be eligible for 12 weeks of unpaid FMLA / CFRA maternity / medical leave when you are unable to work, continuation of group health benefits, restoration to the same or an equivalent job upon return to work, with accrued benefits.

If you qualify for both, you get both. If you are out longer than those guarantees, they can terminate you.
