i need to set up an estate for my father who passed away last year his only asset is a $1500 pention, no will and my sister and i are his only children no living spouse we need the estate to collect how can we do this on our own
Answer
1.Call the pension administrator and ask what he needs to avoid going through the expense of probate.
2. Summary procedure for a small estate. Speak with your County Probate Clerk.
Answer
You may be able to do a Disposition w/o Administration through the Clerk in the Probate Court. Give them a call to find out what you need. No attorney is required for this procedure and it is for cases such as yours, if you qualify.
