I did not know I was being sued, until I received a letter from an attorney-at-law today stating he can represent me in the lawsuit, I filed a Chapter 7 in 9/2000 and was discharged 12/2000; I also filed a Chapter 13 9/2005 and was discharged 12/2008 but case wasn't closed until 1/2009; it took awhile for my employer to stop sending the payments to the trustee; when and if possible can I file Chapter 7, I contacted the lawyer that sent me the letter and he stated I can file Chapter 7 in 9/2011 but he states can tie the company that is suing me in court for a couple of months so that I will not have my paycheck garnished or a judgment entered, how is that process done and I have yet to receive notification that I am being sued.
Answer
Depending on the value it could be lost in a Chapter 7. You can file a 13 now and, if there is little equity, a 7 later. Call me for more details - 888 317 9336
