When going to court for child support as a father, do judges consider if a father has full custody of a child or children already into the support order.



Answer

The statute only allows deduction for a prior support order, so that him having custody is not a basis for a deduction. One may argue a deviation from guidelines because of the custody, but many judges will not do so,
