LaPorte will not go to Tulsa to look for the person. However, if the person gets pulled over in OK or any other state, the person will be arrested on the felony warrant and held in custody while TX is notified to come and get the person. The person will then either waive extradition or fight extradition (and lose - it always happens as long as there is a valid warrant), and will then be brought to Texas. (Generally states do not extradite for misdemeanors - just felonies.)

The basic reasons: 1. willful abandonment or substantial refusal to perform parenting function (looking for dependency type facts here); 2. abuse of child; 3. domestic violence. Sexual assaults on minors is a very major concern.

That said, "risky situations" is vague and may not fit within the type of categories. Don't get caught up in the word "custody." It doesn't really mean much in Washington state. If you think your ex is creating a danger to your child and the residential schedule isn't in the child's best interest then you may make the petition to modify, but it is a very major decision for courts to make. Courts will be loathe to completely take a child from a parent (perhaps moreso if its the mother, but that shouldn't be a factor) without severe reasons.

Employees are entitled to mobility as a matter of state policy, and this is reflected by B&P 16600 which makes contracts restricting an employee's mobility illegal and unenforceable. She will likely allege horrible things about you as well, domestic violence against her, abuse of your son, etc.

The problem is that your husband may try and change the beneficiary. Maybe he will not be able to if there is a requirement that you have to consent, but he could falsify your signature.

My advice would be to see a divorce lawyer now and not rely on probate and pension law to save you. If you commence divorce and equitable distribution proceedings, you may be able to get what is called a QDRO (qwa-dro - or Qualified Domestic Relations Order) addressing the pension. Your share will be separated out and your husband will not be able to change the beneficiary.

It sounds like the vendor is asserting s mechanic's Lien on your property. If they comply with the procedural criteria, they can do this. Hopefully, the contractor was bonded, so you can make a claim for what you have to pay to satisfy the vendor's debt. But, you have a limited time in which to make your claim on the bond.

This is not an intellectual property law question, it is a personal property law question concerning age of majority and parental control.

Under Illinois law (Chap. 755, Act 5, Art. XI, Sec. 11-1) A person who has attained the age of 18 years is of legal age for all purposes except as otherwise provided in the Illinois Uniform Transfers to Minors Act. --

Assuming the car is not held for you by your Mom as custodian under the Illinois Uniform Transfers to Minors Act 760 ILCS 20/1, which sounds unlikely from your short question, you are entitled to your car.

Take your title to the local police department and ask them to come to the garage and be present while you get it. If your mom refuses to release it, they will make a report of the incident. You take that and file a small claims case against your mom for release of your car. The Small Claims Court judge will then order her to release it, and hold her in contempt of court if she continues to hold it.

Unless you are ready to move out and support yourself, you will want to think carefully before doing all this.

Once you are 18, this is illegal for your Mom to keep your car without your permission since it is your car and not hers, unless you owe her money for which she is holding the car as collateral according to some legal agreement she can prove or pursuant to a trust which doesn't require release to you until a certain age such as for example 21.

As I understand your question, you were charged and found guilty of assaulting your niece who is handicapped. You then appealed. Your niece later died and you want to know if the state can still proceed. If that is correct, then the answer is - of course they can still proceed. It appears they have an independent witness who claims they saw you assault your niece. A lot of your question just makes no sense at all, for example: " i believe the state is prosecuting me not my niece" - well, yeah - why would they prosecute the victim? And, "nor did my niece agree to the charged by saying no it didn't happen" - if she agreed with the charge she would have said it did happen. Finally, you state "there is no physical or picture evidence what so ever" yet according to you, the state has a recording of you and an eye witness who was a former aid to your niece. The state has certainly successfully prosecuted people with less evidence than that.

When you receive the subpoena, you would have to file a motion to quash it, but the grounds are very limited. See PA RCivP 234.4:

Family Court is a "court of equity," meaning fairness. There are few hard and fast rules that the courts cannot bend to achieve substantial fairness and reasonableness. Therefore, the courts expect the parties to also be flexible and fair and only bring genuinely unresolveable disputes and serious abuses into court (not that it works out that way with all the petty squabbling people do in Family Court). So when it comes to picky details of orders, the court is going to expect, and will enforce, REASONABLE compliance with the order. So if dad takes the kids to visit his parents and it's getting late and he doesn't want to have to leave to drive the kids to the designated spot, and it's only 5 min. out of mom's way, and it's once in a while, the court will expect mom to reasonably coooperate. If dad meets a new woman who lives an hour and a half away, and he and the kids start spending most weekends there, can he make mom drive there every weekend to get the kids? Not unless he can persuade the court to modify the order to say that.

Grandparents have few rights here and under these circumstances probably none. You may want to start right away contact any free or low cost legal services in your area in the event the grandmother chooses to pursue an action against you. Most importantly, contact the DSS and let them know what is going on and ask what they advise.

I am a resident in a townhome community. My particular townhome is being managed by a real estate company. Ever since I moved in, which is August 6, I have had noise disturbances from my neighbor. I at first tried settling the matter civilly yet the mother left a note on my door telling me not to come over to their house again. She left a phone number and I called several times and left messages but never an answer.

I informed my management of this and they said they would do what they could to get in touch with the neighbors management and see if they could stop the noise. This has gone on for a month and a half. I keep complaining about noise and they keep saying they will do their best to try and get them to stop. Finally, I was told by my management that I just need to file a police report as they have done all they can do.

I requested that I be able to terminate the lease and they said that they do not allow that. The only that I could do is sublet the townhome. I pleaded and asked them to actually contact the owner of the townhome that I occupy and ask them if they would make a special case. They still have not told me if they have honored my request or not.

For me, I feel that constantly being awoken every Monday-Friday by the children clamoring up and down the stairs getting ready for school, their loud televisions during the evening, and their loud get-togethers warrant me the ability to terminate my lease. I have spoke with the police department and they said that I have to call them when the noise is going on but many times, it is intermittent and impossible to have an officer to come over and verify without them staying the entire day.

Therefore, legally, am I able to send a notice saying that I am terminating my rental agreement due to constant disturbances? I am not trying to make things complicated nor so controversial and figure this is the easiest way. I even asked if there was a fee that I could pay to break the lease and they said nothing existed. I really want peace and quiet and I feel that I have been patient enough. I have endured this for a month and a half and have paid more than enough money to them. Any help and guidance that you could provide would be helpful.

It will depend on the lease. If there is a clause as to noise pollution you may have an out. An attorney will have to review it and give you some advise. As to breaking the lease without a proper reading of the lease could cause you to be responsible for the payment of the term.

If a man is under investigation for child molestation and openly admits it to the police and a court mediator during a custody interview, but has not been convicted can he still get unsupervised visits with his child? His child not being the one he violated?

First, what did he openly admit too? The crime he is charged with? or just that charges are pending? I would hope that any mediator would immediately inform the court that he admitted the to the crime and only recommend supervised visits. I would ask for no visitation under such circumstances. I have never had a situation where someone who is under investigation for child molestation has been given anything but supervised visitation. Even if the mediator was so bad as to not take into consideration the circumstances I would object and let the court know why. I would also present the evidence to the court regarding the charges such as the Police report.

You need an attorney in this situation. At the very least you need the assistance of family law facilitator's office in your county to help you with what your trying to do.

The injury is just a coupl scratches, that broke a lil skin but not puncture and does not require stitches. We have not reported it. My wife does not want to be apart of the "agaunat pit" movement. But I feel someone should be held accountable. The owners vet classified the dog as a mix breed. Which allowed it to be accepted in complex. My son altho just scratch on his penis and his inner thigh is now saying he is scared to go back outside. Obviously traumatized a little bit. No doubt he will overcome this in time w our (his parents) help. I dont know what to do. The purpose of the hearing is for the plea offer to be read into the record, the judge will ask the defendant whether he/she understands the offer and is in fact rejecting that offer. If he intends to appeal based on newly discovered evidence that is evidence that could not have been discovered before trial. The milky oil is because there is coolant mixed in with it. This happens because a gasket inside the engine failed. That being said, oil is an awesome lubricant. Oil mixed with coolant is not. The engine effectively chewed itself to pieces because it was not properly lubricated. The loud banging you're hearing is because the lack of lubrication caused a spun bearing ( a VERY bad thing), and the loss of oil pressure is either because the oil pump died, or because all the oil is now gushing out where that bearing used to be and not lubricating anything else. What I'm trying to tell you is that you need a new engine, yours probably cannot be saved.

I am sorry for your loss. Wills in Georgia do NOT have to be notarized (although there is an advantage to having an attached notarized self-proving affidavit, it is not mandatory. hi!,had the same problem with our 93.Disconnecting the plug to the tcc solenoid corrected our problem.On the upper right hand side of the transmission(behind and just slightly below the alternator)there is a black plastic plug in.Pry the plastic locks away on the side of the plug and wiggle it out to disconnect.Our mechanic suggested doing this after we described the same stalling problem to him.Hope this helps with your problem,it worked for us.Replacing the tcc solenoid is an unneccessary cost,in my opinion.Just be sure to cover the end of the plug afterwards to prevent road dirt from getting in there.,...Ron C

I would be very leery to purchase anything from anybody while there's still a lien attached. As you probably know, this entitles the lien holder their right to however much was loaned against the vehicle, which must be cleared at the time of title transfer. The dealer should have taken care of this when they purchased the car from the prior owner.
Assuming the vehicle is worth pursuing, try making an arraignment with the dealer where they will allow you to accompany them to the lien holder's business, at which point the bill can be settled. Under no circumstances should you pay for the car without them first taking care of the lien.

If the break is on the client's property, the suppliers take the position that the customer/property owner used the water and owes for it. But, that can be litigated. So can the bill, if the break is in the supply line, but still not on the customer's property. Of course, if someone purposely or negligently caused the break, they may be liable. I did not research the issue specifically for your question. However, I doubt that there is an appellate decision ruling on this issue as to a single home or apartment.

If this is a common occurrence, there may be a way for you to break your lease. Normally a landlord is responsible for repairs that the tenant did not cause, but you need someone to look at your lease. Illinois does have a Residential Tenant Right to Repair Act that you may be able to use to force the landlord to make the repairs or to move out once the lease is reviewed. And if it is a common occurrence the landlord may be responsible for the repairs because it knew or should have known its security features were not adequate, and if the place is insecure Illinois does recognize what is called a "constructive eviction" which is where a place is so deficient in one respect or another that the tenant can consider itself "evicted" but this requires moving out after notice to the landlord that could still invite a lawsuit for rent, and I would not do this without an attorney's help. But being broken into is definitely un-nerving. Best of luck.
