If you and your car are pulled over by the police and you are not given a driving violation, but are cited for for possession of mj (even though you have a medical mj card), is the ticket still valid or should we fight it.
Answer
You must go to court and "fight" this charge. Your medical mj card is a defense, but you have to raise that defense in court. Often the prosecutor, once s/he sees the med mj card, will dismiss the case. If not, then it's impossible to say what else you can do because I don't know enough about the facts of your case.
