What recourse does one have if an ISP has given out their identity in response to a Subpoena Duces Tecum (civil) without notifying the user and allowing time for the user to move to quash? This appears to be a violation of Federal Code, Virginia Code and the ISP's own Privacy policy.

If this is a violation of the ISP's privacy policy, then you will have some leverage over them but their TOS probably greatly limits your potential damages claim. Regardless, they are required to comply with a court order. If I knew which ISP this is, I might be able to give you some options with them.
