I rented my home this summer to 5 unrelated tenants, who violated the lease with a lawn party, subletting and damage above the normal wear and tear, the lease was less than 125 days, the security deposit was not held in a separate account The security deposit was used for repairs and cleaning and damage, I do not think I needed to hold this money in escrow account since this was a short term rental, please respond Thank you Joyce



Answer

By its terms, the Rent Security Deposit Act, NJSA 46:8-19 et seq, does not apply to seasonal rentals of 125 days or less where the tenant has another residence.
