I bought a home in VA 3 years ago. I just found out the fireplace flue and shell are no good. Is it legal to sell a house when the fireplace is unsafe, although a VA inspector "missed" that on his inspection.



Answer

Quite legal (in my opinion) and no need for the seller to disclose it to you

unless you specifically asked him or her about these specific defects

prior to your closing on the property.

Whatever recourse you may have in this matter (assuming no misrepresentation on the part of the seller) would likely lie against the home inspector (my further opinion).
