My question actually relates to that of a sentence in which pertains to the charges of what started out as a DUI but plead to a habitual traffic offender. I am taking a plea in adams county on the july 14th of this month and i am going to be sentenced to a year of prison time (max). What i want to know is since i am a non-violent offender and am currently taking some drug and alcohol classes (in case thats any benefit to this) would i be able to file a motion for reconsideration at some point during my sentence, to possibly get out any sooner? I've been told that i am able to do it at 120 days into my sentence. Is that true and would that apply to me being eligible for something such as that?
