about 5 years ago i was charged with posession of meth paraphnelia and marijuana i competed the pti program. but about 2 weeks ago i was charged with dui for drugs (pills) two of which i did have a prescription for but the pain pills i did not have. i almost his a police officer head on and counldnt hardly drive. i just attended my court hearing where i denied the plea deal they gave me thinking i could beat it. my question is if i get found guilty what will my sentecnce end up being? its my first dui but my second run arrest for drugs. will almost hitting the cop be worse for my sentence?

Your sister needs intervention, and should take refuge in a local women's shelter. She needs psychiatric help.

There are no laws that require that your sister remain in the US. Your sister can return to Sweden for a visit - long enough to get a divorce in Sweden. However, because of her unhealthy state of mind that it is unlikely that she would do that.

If she would agree to get psychiatric help, she may get enough help to be strong enough to assert her independence.

First and foremost, she should seek and obtain a protective order to get him away from her and so she can get immediate emergency custody of their daughter. She needs to seek professional help. If she doesn't do anything to protect her daughter from being exposes to the abuse, DCFS could take the child on the basis of the abuse and on the basis of your sister failing to protect the child from the exposure to the abuse. Should that occur, the first people the state will look to for placement of the child would be family members. Family could file a guardianship proceeding but it would have to be here in Utah where the child resides. I think under the circumstances, the court would grant the guardianship even if the father contested or opposed it.

She is certainly free to go to Sweden if she would like. However, the concern I have is that if she takes the child with her, the father could immediately file for divorce in Utah which has jurisdiction over custody of the child and he could seek an order requiring the child's return to the United States. Also, she may have some difficulty getting the child out of the country in the first place without the father's permission. If he gives that permission, then she could go with the child with the understanding the father could commence legal proceedings here which may require her to return.

Frankly, she needs to get the courage to simply file for divorce here in Utah, obtain custody of the child and work through the details of the father's parent time with her living in Sweden.

Without seeing the actual lease it is not possible to give you a definitive answer. From a pragmatic stance, you are not in the last month of your lease since you have not notified him of your intent to vacate, rather you have notified him of your intent to lease month to month. I think an argument can be made that you need to pay July's rent to avoid eviction. I see you argument that the written lease is ending and therefore your rental applies as last month of the original term. Without seeing the lease I cannot tell you whether the agreement is subject to that actual interpretation. If you want to remain you are better off paying the July rental.

It really depends on your lease. I am sure it stated that you were to give him 30 days notice of your leaving. I suggest you do that immediately so that you don 't have to continue paying rent. I suggest you pay July - otherwise he will take you to court and you will end up paying way more than the problem of just notifying him and paying the one month. The law in NJ and in most states tends to side with the mother no matter how bad a mother she may be. My fear for our son is that since his little girl is his world, if she should be no longer a part of his world, he might not be able to go on without her. I do not mean he would do anything to his wife. I am speaking that he could do something to himself.

Would you think that if a client in uncomfortable with the nature of something her male attorney says, it would be ok, to tell him how she feels. This happened to me recently at a meeting with my male attorney and another attorney. He said something that made me feel very embarrassed, that i even turned around in my chair, not being able to face him. I told him how i felt briefly. Then the next day, i took my time, and wrote him an email expressing how embarrassed i was and i made sure i was not rude to him. Ps. he emails me back, dropping me as a client, saying i make a big deal of nothing and that i'm being ridiculous. I am so shocked and hurt.

One thing is for sure - you have your terminology all screwed up. There is no magistrates court in NC. We have a Small Claims Court where cases are heard by magistrates but these are civil matters not criminal so if you are going to small claims court you are not going there for larceny and possession of stolen goods. If you are sure the issues are larceny and possession of stolen goods - you will most likely be going to criminal district court. If that's the case, your brother in law may not be the douchebag you think he is. In criminal district court, the decision to dismiss or in your words 'drop everything') is exclusively in the hands of the Assistant District Attorney. They may or may not take your brother in laws input into consideration. Either way you need a lawyer because you don't gots a clue as to what's going on but if you have to go it alone just make sure to stress over and over again that taking the game system was a mistake when you moved and that you gave it back.

Read the statute, do what it says. Call me if you have any questions after you read the statute. You do not need a specific form, you only need to say what the statute requires you to say. And deliver it to the clerk, do not mail it. Get a stamped copy that the clerk received it.

If it turns out the court has already approved your consent (which they may have done even if the adoption is not final), read subsection (3) of the statute. You should probably find out if your consent has been accepted by the court so you will know if your revocation is effective. If the person at the clerk's office will not tell you, ask to talk to their supervisor.

I drove up there to be with my sister and brother, we have different mothers, but the same bio. father. Obviously, there is more to the story and we only know one side - yours. Nurse's don't call security for no reason, and whether it was right or wrong, we don't know the other side. Doubtful. Your mother should have filed a paternity case against your father. There is something called a statute of limitations (also "laches") which is a time limit on how long you have to file for support. Since support might be had for a minor child until the child turns 18 and is no longer a high school student, one would have until the child reaches that age to file for support. Basically, it should have been filed 28 years ago.

Mr. Taberski is basically right. The only correction I have is that support can be obtained for up to three years back. So when the child turns 18 and completes high school or leaves high school, the clock starts ticking, but you can still go back three years. So at 19 there is still two years of back support you can go after. At 20 there is one year, etc. Unfortunately at 28, it is too late to go for child support. You still may want to file a paternity action, however, because if he has assets, you would be an heir upon his death once paternity is established.

However, as executor, he likely does have the power to make decisions regarding a sale...with the caveat that those decisions are excercised in a fiduciary capacity and in the best interest of the estate. Here, he seems to be acting unreasonably [30 days on the market is not very long]. Are there other issues here? [i.e. does the estate have no money to pay the real estate carrying costs that would require him to move quickly to lower the price?].

If all the beneficiaries object to lowering the price, you have two options. 1. obtain a professional appraisal of the house, and file a motion in court to object to the proposed price reduction and sale; 2. wait until the house is sold and contest the executor's accounting, objecting to how the house sale was handled. However, unless you are talking about a lot of money, neither option makes much economic sense.

The first payment I missed on a Credit Union car loan was back in August 2005 and I have not made a payment since for various employment, health reasons etc. I paid $25,000 out of the $30,000 owed, still owing a balance of approximately $5,000. There is no statute of limitations to repossess a car because technically it is their car (that's why you don't have the pink slip) and your account fell through the hole somehow. It could be that your vehicle at this time might not be worth the $5,000 you still owe, not to mention the interest and penalties since August 2005. It sounds like you should just continue to drive the car until the Credit Union decides to take the car if it ever happens. You could talk to the CU but they might then realize that someone screwed up and didn't go get the car from you and they will then hurry up and get it now. It might be that you have moved and they couldn't find you or that the CU went out of business. You have been lucky for over 6 years, why not just leave it alone? The problem will be that without the title you cannot junk or donate the vehicle at the end of the vehicle's life (again, because you are not the legal owner).

Generally, the answer is no. A surviving spouse, assuming the estate is in PA, is not directly liable for a deceased spouse's debts. However, the surviving spouse may be indirectly liable. You do not indicate when the person died, where they lived at the time of death, if the deceased had a will, whether a probate estate is pending, what probate assets there are and what types of debts are at issue. Assuming that there are probate assets, the deceased spouse's estate is obligated to pay any claims out of estate assets (minus the family exemption). If there is enough money, all claims are paid before the beneficiaries inherit. If there are insufficient funds, then claims are paid in order of priority, beginning with administrative expenses, funeral bills, taxes, medical bills and then anything else. There is also a law providing that certain family members are liable for nursing home care given to the deceased.

What I suggest is that if you are concerned, talk with a probate attorney to assist if the surviving spouse is deceased. Even if a probate attorney is not needed to probate the estate, the consult will be beneficial in allowing an attorney to review the documents and provide insight regarding the payment of any claims.

It is unclear from your question if you are asking this question because a spouse has died or whether you are just anticipating problems in the event of a death. If the latter, then it might be beneficial for both spouses to at the outset consult an estate planning attorney. It might also be a good idea for the debtor spouse to talk with a consumer attorney and see how the debts might best be resolved, whether by filing bankruptcy or through some other means (debt negotiation/settlement or debt consolidation).

We signed a lease in Cecil County, MD on a house commencing August 1, 2011 for $1000.00 per month. Our lease stated to give 60 days notice of intent to not renew the lease. On May 30, 2012, our landlord contacted us via text message to see if we wanted to renew the lease, and we said yes. The landlord promised that the lease was on it's way, then never sent it. The lease was finally received on June 29, 2012 with a new rent amount filled in of $1400.00 per month. So, our landlord increased our rent by 400.00 per month (which is a huge rent increase...40%), and gave us 32 days notice of a rent increase to commence on August 1, 2012. We cannot afford $1400.00 per month and do not wish to renew/sign the lease. Can we give 60 days notice now that we are going to move out (September 5th) and are we obligated to pay the $1400.00 for the month of August for the landlord's failure to give us adequate notice of the rent increase allowing us to decide whether or not to renew 60 days prior to the end of the original lease? I have tried contacting several attorneys (hubby is a member of Hyatt Legal Group Plan), but the ones I have tried are either on vacation this week or at a conference. Some of the answer would be in the lease. Does it have a provision for increase in rent if you renew the lease? If so what are the provisons and what requirements does the landlord have. If nothing in the lease with regard to increase then what has been presented we seem to be more an offer for a new lease and not a renewal.

Yes you can still go to jail. Just because you were not arrested, does not mean that the prosecutor can't sometime in the future decide to prosecute you. In fact for a theft charge, the statute of limitations is up to 5 years. In fact, theoretically, you could pay it all off, pay the $200 civil theft amount, and STILL be prosecuted. That said, you need to do what you can so as to avoid the possibility that the company decides to contact the state attorney and make this a criminal case.

The renewal notice provision you describe is a contractual situation and really has nothing to do with the conditions of the property at the beginning of the lease term (which you obviously accepted). If the lease calls for notice to be given, then in order to be in compliance with that provision you should give notice accordingly. As for the penalties you should review the lease and see if those penalties are mentioned. Just because you are not aware of a term contained in the lease is not a defense. You should have a copy of the lease you signed and the notice provision and penalties should be there.

As for recourse, it is not clear what recourse you would be entitled to at this point. You may be able to negotiate with the landlord on the amount of the penalty, but if it's in the lease contract that you signed, then there is a good chance that it is enforceable. The penalty you describe is not llikely to be viewed as unreasonable in a commercial setting.

As for the conditions that you complain of, your proper recourse would have been to address them during the lease term, and it sounds like the landlord curred any perceived defects.

It sounds as though you are asking a group of attorneys whether or not your attorney is handling your case properly, without those attorneys knowing anything about your case, or your attorney.

This is a difficult and awkward question to answer. It is a tort in California for an attorney to lure another attorney's client away from him. It is called tortious interference in a contractual relationship. With that said, it happens all the time, and there are many attorneys in this state who have grown fat off of the sweat of other attorneys.

If your attorney is not returning your calls, and you are not one of those clients who calls 5 times a day, (we do have other matters, from time to time) you may have to contact the California State Bar, regarding abandonment of your case.

If your attorney does screw up your case, you do have the option of filing a malpractice action against them.

You can bid for the home. Massachusetts law requires that your current lease be honored by the buyer if you have one. You should also demand from the Landlord return of security deposit and last month's rent if given as a deposit.

If you do not have a lease, they will have to evict you. If you are elderly or have a young child you are entitled to stay 6 months before moving. If the lender buys it, they will try to sell it quickly, you might be able to make a better deal if the lender buys it, assuming you want to buy the Condo.
