is it legal for my employer to wait 13 days past my pay date and then on the day he finaly pays me to lay me off?

Unclear. Most employees are paid "in arrears" so if this was your regular pay date for the most recent pay period (up to 2 weeks in some cases) it may be ok. Otherwise, as long as you received full pay up to the layoff, what is your goal?
