The supervisor informed me that she and her superior took it upon theirselves to place my son out on a bus stop. My son became ill and the supervior gave him medication to take. She admitted to me that she knew it was wrong to give employees medicine from her own desk but she did. He passed out and was taken to the bus stop. He was later picked up by the police who transported him to the hospital. I later got call from police that stated that he had some loose pills in his possesion. Also got call from his supervisor who stated that she did not have any contact info for him but again she is talking to me so i dont understand. My son was in a coma state for a couple of days. Now he has to go to court for the pills that was on him. He states he has no knowledge of what happened. So what leagal advise is needed and by us not having money who can help him.

However, they are asking that I provide my social sec. number. Is this required by law? The settlement is only a couple thousand, and there is no punitary settlement, just recompense for injury. I'm concerned about privacy issues.

Their reason for asking is due to IRS reporting requirements (see Form 199-MISC). I know that they have to send them to attorneys when settlements total $600 or more. In regard to individuals, I am not sure; but I would expect that they have to report the payment made to you especially if a portion of the settlement was for lost wages.

Due to a 2008 Kentucky Supreme Court Case, the term "primary custody" does not mean much if anything. What you are actually wanting is to modify timeshare so that your children live with you most of the time. The only standard the judge has to meet to change timeshare is that the change is in the best interest of the children. The judge will look at many factors, including the environment they live in, to reach the decision.

You don't HAVE to accept changes to a contract or lease once both parties have signed the original. There might be occasional exceptions where the original contract specifically called for the parties to decide some collateral matter later on, but such instances are pretty rare.

In your case, it sounds like you have a sublease of a sublease. Somewhere up the chain is a lease between the landlord and a tenant. Very possibly, you are being asked to make changes based upon a demand from someone higher up the chain of (sub)leases, or someone discovering some term or condition that seems to call for a correction or modification to your sublease. Therefore, the person who is asking you to make changes in your sublease may have little choice.

I think you and your sub-lessor may not have fully studied the legalities and rights involved in your transaction, and the sub-lessor is trying to save the deal by imposing modifications to the terms. Perhaps you (and he) have no choice. If that's the case, you can refuse to make the requested changes, but then the sub-lessor may be unable to perform his obligation to make the space available to you. You'll end up with no space and a potential lawsuit against your sub-lessor.

So, my guess is that your alternatives may be limited. Either refuse the changes and lose the space, or accept them. He (maybe) isn't canceling; it's his landlord canceling him.

You should inquire why the changes are necessary and whether your sub-lessor has any latitude to deal, and whether he made a mistake in the first instance. Possibly you can also contact the property owner/prime landlord.

Without more facts, I can't give much further advice, and I may be wrong, but it sounds as though your sub-lessor misinterpreted his rights.

My main question is: how can I research the title for this condo, to make sure it really is owned by Fannie Mae, who is selling it to me, and not by the previous owner, who foreclosed? And does the previous owner have any legal right to take the condo back after I buy it?

You need to do your due diligence prior to the bid.

Now you have a big can of worms. You need to pull title, pay the association, pay the assessments, pay the special assessments and pay property taxes, as well as any liens that were not cleared off in the foreclosure.

I agree with Mr. Mchelotti about the fact that the auction probably had guidelines about what we call due diligence -- which in part means whether you can inspect the unit, as well as find out the kinds of things you are asking about. HOPEFULLY the auction provided much of the information you're talking about. Then, once you go do auction, if you haven't raised any questions, you're "done". That's what they are often all about.

The next step should be, however, that the auctioneer or the seller will present a formal real estate contract to you that was probably one of the resources on line that you should have been given and looked at. The contract will identify many of the things you are talking about. As Mr. Michelotti says, title may be subject to outstanding assessments and liens for them. Sometimes, if there was both a first mortgagee and second mortgagee, if the first mortgage was foreclosed but somehow not the second, you may wind up with a unit with what was a second and because of the foreclosure is now a first. The contract should obligate the seller to provide you with a title commitment as part of the sale. If not, you are on your own as he suggests. I hope not. As to whether the prior owner might be able to get the property back, that in great part depends on whether the foreclosure was proper, and whether you get a title policy as part of the purchase. If you do and the prior owner comes back, no you should not lose title but rather would have a claim against the title insurance company on an ownership contest issue.

It takes YEARS for attorneys to become proficient in these matters and you want to DIY? If you paid less than $3,500 for the unit and are willing to risk it all, I suppose that's up to you. Otherwise, I heartily recommend you bring someone like Mr. Michelotti or me on board. It's called peace of mind. No?

PS attorneys like the "sale side" of deals because often the attorney can produce the title insurance required of the seller and earn a commission for doing so. On the "buy side", especially for a condo where there is no concurrent sale, that doesn't happen and so it's pretty much a la carte because condos are just typically that much more complicated. And with the added ingredients of a foreclosure, possible receivership and auction sale, just that much more. The only possible "silver lining" is that if the sale is being authorized by the bank that foreclosed, it will want a clean deal with few problems. Possibly......

This should be re-posted in criminal law as it is not really a civil litigation question. You could ask the police to try to get him to stop, but they may consider it a civil matter. You have to decide if the ex-roommates claim is reasonable; that he was not on the lease and there is no paperwork does not matter. since he knows you work address, he can come and harass you personally. It might just be better to offer him more or the whole amount of money in dispute.

Before talking about your husband's citizenship, it sounds like what he's looking for is permanent resident status (aka a green card). If he overstayed a non-immigrant visa (as opposed to illegally entering the country) he should be able to get a green card by virtue of his marriage to you, a US citizen. He should not have to leave the country -- he can remain here and file for "Adjustment of Status". There are quite a few USCIS forms to fill out (I-130, I-485, I-765, G-325A, I-864) but if all goes smoothly he should have a green card in about 5 months.

Once he's been a permanent resident for 3 years he can file for citizenship. In that case, it does not matter how he got his green card, just that he got one. No one needs to leave the country to file for citizenship.

Yes, your boss can require you to arrive early to "get settled" and can fire you for not being ready to work at your assigned time. Getting settled would include preparing your work area, changing into a uniform, using the restroom, etc. He must, however, pay you if you are performing "work" and that time will add toward your total work time for calculating overtime. The definition of work from the Fair Labor Standards Act website is below (http://flsa.com). My best advice is to seek employment from an employer with whom you have a more amicable relationship.

If you do end up filing a complaint through Alabama's FLSA office your boss the FLSA prohibits retaliation or discrimination against an employee who brings an FLSA case; however, the FLSA does not prevent "routine hassling." Routine hassling would be acts such as changing working conditions or schedules to minimize or eliminate FLSA overtime liabilities in the future.

At this point, based on the limited information, the best advice that can be given is to continue your plan to complete the AA meetings. I would suggest you bring an attorney with you if at all possible. It would be best to sit down with an attorney before hand to review your record and see the best course of action from there.

I would note that there is a new interlock system being put into place on July 1st. If your problems have not been solved by then, it would be a good thing to look into.

Also - stop driving while your license is revoked. It may only be to get your drunk friend home but every time you do that, you are going to risk having to wait a longer time to get your license, more criminal charges on your record, and more money out of your pocket.

I mean he is on every sort of government assistance available and still struggling really hard to survive and support current family and find a steady job again but has had no luck whatsoever. he never see's the child he owes support for b/c the ex quit honoring visitation when he lost his job, filed some crazy ex parte order accusing him of being a criminal and got it signed suspending all his visitation, canceled the hearing (which was scheduled 59 days after the ex parte) and has just let it ride claiming thats her excuse to keep this child from her father and her two half siblings (who the ex wife poisons the mind of the minor child with brainwashing that they are not her real sister and brother and she should hate them), now changes her story from original claim after he is now obviously not a criminal nor subject to any charges etc. and attacks the disabled stepmother as being an unfit parent with no basis whatsoever and refuses to sign for the checks the father does send via registered mail... blocks his number in her phone so that he cannot call their daughter just to talk to her and tells daughter when he calls from a random number and it gets answered to get on the phone and tell him "daddy I dont want to talk to you and I dont love you"... and oh yes--the ex wife states that if he divorces his current wife the ex says she'll let him be a father again to their daughter again and not imprison him for the past due support..... if not she'll "throw him in jail as long as possible and he'll never see his daughter (their child together) again... the list goes on.... and on...

Original jurisdiction and final order / decree issued in Chatham / GA. Ex wife resides in that jurisdiction still. Husband lives in SC and has for a long time. Husband tried to modify the support order long ago when first lost job but since not custodial parent Child support Enforcement refused to take it, he tried to do it privately by domesticating the order in SC and utilizing the UIFSA to initiate the support modification and ex wife objected and won. He cannot go back to chatham to modify it b/c they'll arrest him the minute he steps foot over there to show up at modification hearing by attaching a contempt hearing on the same day back to back on calendar..... sorry so long and confusing just a very heartbreaking story that I cant seem to get anyone to help him with and he has no money to hire an attorney in ga b/c every one is either conflicted out or wants $4k retainer. Also an issue where the judge assigned to case is pulling favors for her former buddy the father of the ex wife and b/c of the Uniform Superior Court rules in GA he cannot get another judge without a recusal motion for abuse of discretion (well documented) and no attorney in Chatham vicinity will file a recusal motion... I think he even filed one pro se but they just ignored it......Surely there is a solution to this disaster and surely the fundamental principles which our judicial system is so largely based upon is not lost... refering to the system being used as a sword in this case?????

I'm not really up on the law on this, so hopefully another attorney will follow up on this. As a former public employee, under the SFPERS system, however, I can tell you that I was eligible to transfer my SFPERS credits to CalPERS or pretty much any other public employee retirement system in California. I would have been subject to the rules under the system I transferred into, but my $$ and time in service would have transferred. What I can't tell you is if it is mandatory that the new public entity participate in that or not. If they do follow the standard PERS protocols, though, your time and $$ should transfer into the new system if you elect to do so. I just can't tell you if they are required to set it up that way.

Advise the contractor that you are aware that it is a violation of the Business and Professions Code for a contractor to collect payment for more than the actual value of labor and materials in place at the time of a bill or draw. Advise the contractor that if he does not account for all funds paid to date and provide proof of progress before any further draw requests, and provide progress substantiation with every further draw request, that you will file a complaint with the Contractors State License Board and make a demand on his license bond for reimbursement of over payments to date. As a Franchise Attorney I can say the following. Pretty much any writing (email, etc.) will satisfy the requirement. You've said the contract was modified, but did not specify how. The UCC does not require a formal sales contract. In many cases a memorandum or collection of papers is sufficient compliance. The courts have held that a written check can be considered a written memorandum of a sales agreement. The UCC allows a written sales contract to be enforced even if it leaves out material terms and is not signed by both parties. Consult with a good business or franchise attorney in your area for specific advice.

Since it was not registered, I was unable to find an insurance company to insure it. Fortunately, no one was injured but myself. I have told them I do NOT have the money and have no one to even borrow it from. If there is fraud (basically lying) about his actual monthly, income you should be able to have a Motion to Modify Child Support filed now. You will however, have to prove it. Proving the fraud depends on how smart the father is. Sometimes the proof is easily obtainable because they are down right stupid and sloppy about their lies and sometimes they are slick enough to successfully hide their income so that they have a mere $50 per month child support obligation. If the father is smart, you will most likely have to retain the services of an attorney experienced in child support and also possibly the services of a private investigator. If he is not too bright, often a child support enforcement caseworker can bust him. If the fraud is proven, he may be facing some criminal charges. If he is convicted, this could ironically work out to be a bad thing for you because then he is very likely to really have no income - it a whacky system!

As of Sept. 30, 2011 the law changed to make your charge an unclassified misdemeanor that carries a penalty of possible community service an/or a fine but there is no jailtime. Therefore, you are not entitled to an attorney.

Your best way forward is to send them a cease and desist letter from responding to anyone in your name. Ask that they disclose to the subscriber an error with an apology to both you and the customer. You could then send a corrected evaluation to the customer.

Such an action is a deceptive business practice under MGL c 93A. However, while I am sure you can get an injunction prohibiting them from doing such an action in the future, there is no guarantee you could recover your legal fees or other damages. Practically, other than legal fees what is the value of the damage to your reputation and how can it be proven.

I would simply send by certified mail or DHL/ Fed EX a cease and desist letter and a demand for a disclosure to the customer with a copy to you and a demand for an appology to both you and the customer. You might suggest a refund to the customer as well.

Ive also been told by numerous employees at the Chilton County Jail that they cant give me a day or time my son will be seen. It could be up to 3 weeks its all up to the judge. I also stated that he needs to be examined by a Physician. My son is in the process of being eligible for SS disability. (The law actually states a judge may force someone to go to jail until they produce the will.) However, the problem now is that the will may have been destroyed by your stepmother. If it still exists, you do not know who has it. If you can contact the attorney who prepared your father's will (if you know who this is), you may be able to ascertain the contents of the will that way, also. Unfortunately, you probably should have forced production of the will while your stepmother was still living. I advise you to meet with an attorney and discuss the full facts of your case in person.

You need to speak to your family law attorney and if you don't have one, you need to get one. Unfortunately, you didn't give us many facts and your story was somewhat disjointed, but I assume you mean your ex husband did not take you off loans after you deeded the home back to him. This is a very complicated situation and it is more difficult to take someone off of a loan, because the mortgage company has to agree or he has to refinance, which requires a new mortgage company to find him credit worthy for a loan.

If you are already divorced, you may have a problem. If you are not, you need to get this handled through a family law attorney.

The problem here is I bet that your ex-husband cannot refinance for whatever reason (bad credit or judgments or other obligations, like child support which eats up his income). If that is the case, then he cannot get you off the loan and the only remedy would be for him to sell the property. If he does not want to do that then you are stuck.

You should discuss this with your family law attorney. If your ex-husband is able to refinance and just has not done so because he does not feel like it then you can probably take him to court for contempt if the separation agreement required him to refinance the property. If he is unable to refinance (like because of bad credit) then a contempt action will not work because his non-compliance would not be willful.

Check battery connections, make sure terminals are clean (don't underestimate the power of dirty terminals to make your car act up or just die). Check ground connections from battery and starter. The problem could also be the failure of any one of the aforementioned components. One thing easy you can do is have your battery checked. I think auto parts stores will still do that. Otherwise you'll have to take it to a shop if it isn't anything you can find yourself. Hope this helps!

I have a joint mortgage with my sister-in-law. She has stopped paying her portion of the mortgage and wants out. I know the best thing to do is to refinance the house and remove her name from the title. My wife and I are able to keep up the payments so refinancing shouldn't be a problem.

So here's the problem. My sister-in-law wants her portion of the money she put into the house returned to her before she moves out. Is it reasonable and do I have any legal rights to deduct her portion of "rent" from the amount owed to her as long as she continues to live in the house without paying, basically free rent?

As a reference, I cover the property tax in full so she doesn't pay any of that nor does she file it in her tax return because it is better for me since I have a family with child. Don't know if this affects anything.

I'm not trying to charge rent. When I said "rent" I meant her half/portion of the mortgage that she is neglecting to pay.

Example, since the beginning when we purchased the house until now, she has contributed a total of 57K, but has now stopped paying. Now I want to deduct 1200 per month for her lack of payment/contribution to the mortgage fees for as long as she continues to stay in the house living with us; I'm also deducting her half of the supposed utility/electrical/internet expenses.

So my question again is: Is my idea reasonable and legally allowed (though I understand not obligated)? Can I deduct her half/portion per month of non-payment from the amount owed back to her from the time she previously paid?

In order to refinance, you will have to have her name off the title. Once you get the money, then how you handle it depends upon a couple of factors you have not mentioned. If the house is worth more than the amounts you and she put in, does she want just the amount she put in or that amount and 50% of the equity, if there is any? As soon as she signs title over to you, unless she has a provision for her staying rent free, then you could kick her out as being only a guest. That would result in her hating you for the rest of her life. Putting your wife on title would mean a gift to her of half of the house and might even convert your private property half, if any, into community property. You need to prepare a detailed list of the facts and then see a real estate attorney to figure out the best way to handle the situation.

Mr. Shers is exactly right. This is a much more complicated situation than you seem to understand, with potentially very expensive unintended consequences. To answer your direct question, yes, as joint owners you can recover some or all of her share of the costs of ownership if she stops paying. This is based on her ownership, not occupancy. So if she is off title, she stops owing it (but you can immediately kick her out), as long as she is on title she owes it, but you cannot remove her and you cannot charge her rent. What you really are doing here is called a partition and is similar in some but not all ways to a partnership dissolution. It seems you and she have mostly parallel objectives in this situation, but some disagreements on the cost allocations and some other details, and you don't seem to understand all the mortgage and tax implications of what you are doing. If you and your sister are both interested, I would be happy to spend a free no-obligation half hour or so with you both, to go over the situation in more detail, give you some thoughts on the issues you need to work out, and give you some information on the mediation services I could provide if you cannot reach an agreement on all the issues on your own. I could meet with you in my San Francisco or San Mateo conference facilities, depending on what would be most convenient for you, and conference room availability at the time you would like to meet.

When someone files for divorce they put down a date of separation. The date of separation occurs when either of the parties does not intend to resume the marriage. Since you're living apart your date of separation could be essentially whenever that situation started.

Note if you divorce and it becomes an issue there can actually even be a mini-trial on the issue since it matters so much; because after the separation all property acquired thereafter is separate property. Thus if you file the separation date as 3 years ago, and its not contested, then she will have to show you bought the car with community property to be entitled to anything from you. Presumably you two have already split everything when you separated.

However the down side of showing a separation date as 3 years ago is that you may owe spousal support for while you were separated; but that depends. Best to see an attorney to go over the details of your situation.

Let's say you move back in and your ex is gone for months. When he comes back and finds you there,who do you think the police will arrest for trespass when they read the only order the court has entered? Since you are not a U.S. citizen, you could file the I-130 petition for her, but she will not immediately be able to adjust status.

If she does not maintain legal, non-immigrant status, up until the time she is eligible to file for adjustment, she will be denied (unless you become a U.S. citizen by then)..

My husband and his ex wife bought a house when they were married. In the divorce, all that happened was, he put the house in her name. But the loan is still in his name. It is in his divorce decree. She is making the payments on it but would not refinance. Is this going to affect my husband and I when we try to buy our home? What can we do legally to get that house loan out of his name? Can we make her refinance or sell?

Yes, it will effect his credit. Also, if the ex makes a late payment, it will hurt your husband's credit. The bank doesn't care about the divorce decree or who's name is on the title of the house. Your husband is stuck on that mortgage until the ex sells or refinances.

That being said, your husband should hire counsel to review the divorce decree to see if the ex was compelled to refinance or sell within a certain time period. If she failed to do so, he may be able to use the court to compel her to refinance or sell, pursuant to the original decree.

This is a very complicated and fact-based situation, and there are a number of elements which must be met in order to claim property by adverse possession. You shoulda bought Uninsured motorist coverage. You can pay an attornrey to get a judgment against the guy, but it would most likely be uncollectible.

Unfortunately you have learned the hardest way of all that riding without uninsured motorist coverage may turn out to be nearly as bad as suicide. In some ways, as you say, you may as well have gone without a helmet and been done with it. Driving without UI is risky. With the astronomically higher risk of serious injury when riding, riding without UI, well, puts people in the situation you are in.

The problem is that people with money buy insurance, so they can keep their money if they negligently harm someone else. People who don't buy insurance are the ones with no money. So it sounds like from a legal standpoint you would have little or no trouble getting a judgment against this guy, but then what? If the guy has no money, you've got a piece of paper and nothing more.

And that is why you can't get a lawyer to represent you. It's not because we have coal for hearts or are greedy. It's that just like anyone else we don't do useless things. Like everyone else, when we go to work we expect to be earning a living. We can't in good conscience take your money on an hourly fee basis to get you a worthless judgment. And we can't work on a contingency basis when there will be no recovery.

Yes, we all someties work for free, or "pro bono," when there is some real benefit that will come from it. I'm doing a little of that right now, I hope, by helping you understand this situation. If we volunteer our time, however, it needs to be for a worthy cause. Not that you're needs are not worthy, but a case that results in an uncollectable judgment is never a worthy cause. Plus, taking an accident case costs money even if we waived our fees. There are court costs, process servers, copying charges and all the rest. So again you'd be paying money for nothing, or we would be out of pocket for nothing on top of working for free for nothing. I don't think either one of us is in a position to work hundreds of hours for free, or throw away a few thousand dollars, for nothing.

I sympathize with you. My brother rides, including commuting every day and I know he could be in your place at any time. But unfortunately all the law can do in this situation is order the guy to pay you money, and if he doesn't have money to pay, the law cannot help.
