Two weeks ago, I leased my home to a family. In the lease agreement, I agreed to clean the house, paint 1 room, fix a few things, etc. Because the wife was pregnant, I moved out of the house very quickly so I was not able to get a maid service and do the repairs right away. However, I did get the maid to come the day after they moved in and fixed the problems. Now, they tenants have moved out and they want their deposit back of $2700 plus the 1st months rent of $2700. Do I have to give them back their deposit since they were the ones who broke the lease? Since they stayed for 5 days am I legally responsible to give them back the rent?

The lease agreement is the law between the parties. I suspect they found a cheaper place. If you are able to lease the place quickly, then giving them part of their money back would be the honorable thing to do. Again, the lease agreement is the law.

I have an attorney who took my case on a contingency bases. the problem is it has been a year, I had a pretty straightforward claim, I was at work, the building that my job leases space in had some third party contractors do some roof work, they released fumes into the building while making repairs I got very sick passed out, went to the hospital, vomitted, developed migraines, messed up my back, went to therapist 3 times a week for the back and was under care of neurologist for migraines, there was no surgery just therapy, we are at a year now, done with therapy back in December and still on migraine pills. There is nothing else the doctors can do. I am now getting the runaround from the attorney and his paralegal, they will not call me back, answer my emails etc. I would think that the case since there was no surgery is not going to net that much, but something!!!! I would think there would be some type of closure at this point?? Is he also obligated to tell me, he's not going to help me at this point and what recourse do I have?

There are no formulas about when a case should or should not settle. There are no straightforward cases. Dealing with insurance companies is nothing but complicated, tiresome, frustrating and time consuming. If you feel frustrated, think about how your attorney must feel since he is the one spending time, money and effort on your case without even getting paid.
What you need to do is to make an appointment with your attorney, write down your questions, and then go see him. Be nice, respectful and ask about the reasons why the case is taking the amount of time it has taken. Ask to see the file, see the work that has been done, ask followup questions, and make sure that your questions are answered and you have an understanding of your case and its status.
Don't assume that the insurance company is poised to pay you, but your attorney is refusing to get paid! Don't assume that because you have an attorney, the insurance company will automatically fall in line and do the right thing. Don't assume that it is all your attorney's fault...

unless you specifically asked him or her about these specific defects
prior to your closing on the property.
Whatever recourse you may have in this matter (assuming no misrepresentation on the part of the seller) would likely lie against the home inspector (my further opinion).

Is it worth it? Does the lease allow subleasing? If not, you have a problem. Does the person have any money and, if so, how much time will you spend trying to collect? It most likely will go down as a lesson learned. It was a choice to have an informal handshake deal, and the risk that the other person would pack up and leave (or you would ask her to leave) is exactly the risk that both of you accepted in the deal. Had you wanted a more formal deal to hold up in court, you could have done so.

No one here can give you a credible opinion on an issue that has been going on for 8 years, or whether you have any valid claims if you get terminated. Also do no fault claims ever settle? As recently asked I mentioned that they no longer will pay for me to get pain management but if I have something else that I want to try they will pay. Lawguru.com answered I should have my attorney deal with this. I don't have an attorney, I never knew I should have one. I have tried so many things and the only thing that is helping at the moment is pain management. I still go monthly and pay out of pocket because my regular medical insurance will not pay for it, they say it's a pre-existing condition. She never showed up and stopped replying to my calls/texts. I asked (via text) if she could drop it off to the nearest police station or mail it to me (saying that I would pay for any postage and give her a reward in either case). I also asked if I could pick it up myself. She never replied.

My father passed away in July. My mother pre-deceased him. They drew up a will in November 2000. My father remarried 3 years ago but never had the will amended to include the new wife. I am the executor of the will. The car she claimed was hers is titled in his name only. There is also a loan on the vehicle for $13,000. The car is worth about $9500. I am working to try and resolve this with the lienholder. If the vehicle is repossessed, can the lienholder attempt to collect additional monies from the estate? Is the new wife legally responsible for any of this debt? The estate has very little assets.

Sorry to hear about your father's passing, You have my condolences. If there is a deficiency (money still owed on the car note after the repo sale) the creditor can make a claim against the estate, but they rarely do. The surviing spouse may have a claim for some of the assets of the estate, including the vehicle. She may also be able to get the entire will set aside. If the car is the major piece of property, it might be best to just have her make the payments and use the car. If it gets repossessed later, they probably cannot come after her, if she was not on the note.

If you are currently outside the United States and are no longer working for the company who petitioned you for the H-1B visa that was approved, then you technically cannot legally enter (and therefore should not enter) the U.S. on the H-1B visa in your passport, assuming the validity date is unexpired.
However, the new, prospective employer can file an I-129 petition for you as a "change of employer" & you can request the "remainder" of time left on your approved I-129 petition, assuming there is any. Then you could get the new H-1B visa issued at the U.S. Consulate, at which point you would be legally able to enter in H-1B status, as an employee of the 2nd company.
The new company hopefully has an immigration attorney to file the I-129 petition on its behalf, which means this information would come to light anyway.

First off, it makes absolutely no difference if the company is an S or C corp. An asset is an asset is an asset. It may be community property, quasi-community property, or separate property at the time of a divorce, but it's still just an asset.
As for what happens to that asset if you marry and later divorce, that is a LOT more complicated and will depend on what happens with the company and why during the marriage. It is clearly separate property at the time marriage. Unless there is an affirmative transfer from separate property status to community property status during the marriage, it would almost certainly not become full blown community property. It could, however, become quasi-community property, meaning the marital community might acquire an interest in it that would have to be bought out or otherwise accounted for in a divorce.
That happens because the fruits of work during the marriage belong to the community. So if you are a salary earner and you put away savings from your work during the marriage, that is community property, as is any return you make on investing it. Passive asset growth is not, however, community property. So if you own 100 shares of Widget Corp before you are married and they double in price over the term of the marriage, that appreciation remains separate property.
As you can imagine, that gets kind of complicated pretty quickly when your business is your job and it increases in value due to your labors as you grow your business. How much is appreciation of the asset, and how much is "sweat equity?" That is the stuff that divorce trials are made of. A good fair pre-nup that agrees in advance how the business will be treated and valued in the event of a divorce is a really good idea in such situations.

The concern here for my Mother and I is the extent to which my brothers estranged wife is in a position to make a claim on the property that my Mother and Brother live in, - in the event of the death of one of them. It is generally felt that the estranged wife is in a position to collect in the event of my brothers death if his name is listed as an heir to the Deed to the house along with mine.
Although my Brother does have a Son (27 year old) which we're concerned about receiving proper dispensation based on him being a decending heir, the Mother ( my sister-in-law) has pretty much exiled herself from the Family. She has no real interest in the Family other than perhaps collecting whatever is due to her legally in the event of my brothers Death.
If my Mother and I cannot convince my older Brother to get a divorce in order for his name to remane list as an heir to the Deed to the house, how else could this estate issue be resolved such that the estranged wife is left out of this deal financially in the event of the death of my Mother or Brother?

The quick answer is that there is probably nothing he can do at this point. I urge you to tell him to contact his divorce attorney or a new attorney familialr with family law and see if there is anything that can be done at this point. THere is a rule of civil procedure (RULE 60) that deals with mistakes and he might want to talk to his lawyer about that. Also, depending on the wording of the decree/agreement, the portion of the order requiring him to pay the house note is possibly in the nature of support which may be able to be modified upon a change in circumstances. Has she re-married? Has she hit the lottery? Has your husband had an unexpected reduction in income? Really, I think it would be wise to pay for a consultation with a knowledgable lawyer and get a thorough review of the situation. Best of luck.

Well, it will depend upon the laws of each such state where your chosen name cannot be registered by you because someone else already has the same or a very similar name. However, I note that businesses from other states that try to register as foreign corporations so as to do business here, but which are unable to do so, file a registration that gives them a registered name something like this: "Flibbertygibberish, Inc., a Utah corporation, which will do business in California as Flibbertygibberish of California, Inc." I have never encountered this problem so I can't tell you EXACTLY how this slight re-naming is done here, but I'd thing that if you looked at the foreign corporation registration form, it would give the necessary clues.
Of course, every state's rules are going to be at least a tiny bit different, so you'll have to try to process your registration on a state-by-state basis.
Finally, you might want to check each state's rules as to when you have a duty to qualify there before tackling the hassle and expense of actually qualifying there. Be pretty sure it's really necessary for the level of activity you'll have in that state.

I purchased a $50K Dodge Ram SRT10 in June 2007 that did not have a problem until it was brought into Crystal Chrysler in Homosassa, Fl at 30K miles (December 2009). I brought it in for a simple tune up, brakes, etc and when I came to pick the truck up, the engine was blown at the dealership. It was fixed, but, I was without a truck for four weeks because they refused to pay for a rental car and they charged me for a tune up and other items that I did not receive any benefit from (Total Bill $1,600). A year and three weeks later, on January 15th, 2011, the engine is failing again. It has been at Fermin Chrysler Dodge Jeep for the last five months and I am on the hook for over four months of rental car fees which they are not guaranteeing to cover. This is an all too common situation with dealerships and repair shops. Read the repair documents you signed to see if there are any exclusions of liability. If you really plan on doing something, you will need an expert mechanic who will state that the dealer caused the damage. My daughter will be 18 in Dec. I have had many problems with her. She moved out once and then came back. I wanted to kick her out but was told that since I let her come back for 24 hours she was back and that I cannot kick her out until she is 18. A few months ago she moved in with a friend. I was relieved. Her friend allowed her to drive her car knowing she did not have a license yet. She had an accident in her car that they fixed by going to Pick and Pull to get the part they needed to fix it. I told her friend she needs to tell her she cannot drive her car anymore. She ended up taking the car without them knowing she was gone. She went to her boyfriends house and evidently became very intoxicated before she drove back home. She evidently hit a ditch or something but went ahead and drove it home with a flat and ruined the rim. Also the rearview mirror had come off and there was a shattered headlight and the electrical system was completely shorted out. Her friend is 18 and lives with her boyfriend. I got a call from her mother telling me that she had talked to the police and was told that since she allowed her to drive her car once, they cannot say she stole it so it becomes a civil suit. She said that the police officer told her that the parent would also be liable since she is not 18 yet and that she was getting an attorney and taking both of us to court because they knew my daughter did not have the means to pay for this. I feel bad for her friend and hate that she has a car that she can't drive now, but she texted my daughter and told her that she was getting ready to get another car anyway. I need to find out if I will be liable because I can't afford to pay for a car and get an attorney. I thought by paying for this, it would be just one more thing that my daughter has done that she will get away without paying and wanted them to take her to court, but if I am going to be liable then I need to know so I can maybe take care of it without going to court.

Over the past year I've caught sub contractors plugged in to community electric sources which the community pays for. I've asked our HOA management company to ask the builder to have them stop this action and use generators as they should. This past week I actually unplugged the cord from our entrance marquee myself. I asked the HOA management company if I should report this to authorities and included the builder and board members on my email. The builder broke it down for me that his contractors were only using about 50 cents a day. I didn't think the amount was important. I thought that the fact that the community paid for the electric and not the builder or sub contractors that this was stealing and it needed to stop. Should I request legal action be taken or would a judge laugh me out of the court? I have photos and a neighbor that had a sub contractor plug in to her house outside outlet. She asked them to unplug it once she noticed. This is multiple sub contractors doing the same thing every week.

So, we pay the taxes on the property each year and Dad still lives on the property. Of the five children, two have good jobs and one has two big of family, and two barely making a paycheck. He can try to sell his share, which is unlikely. Most purchasers will not want to co-own a property unless it would be, perhaps, another relative.
Since selling is unlikely, absent cooperation, his remedy would be judicial partition. If the property can be literally divided, then partition means doing just that. Since in many cases it is not reasonable to divide the property, say a single-family home on a standard lot, the alternative is for the court to order a sale.
If the sale is inevitable, I suggest you all save time and expense by giving in to a solution. Either, you can agree to sell and get the most for your money or you can try to work out a buyout. If you can finance it, you can buy him out. If you cannot finance it and he does not have an immediate need for his cash out, then maybe you can work out an installment plan.

If they say his pee is diluted, he should immediately go that day to have a blood test done to show there are no drugs in his system. If he does this each time they claim to have a diluted urine sample then perhaps they will believe him after a couple of times. Also, once he gets that settled and if he has finished the balance of the requirements of his probation, then he should request early termination. (If he continues to have problems with the diluted urine claims despite blood tests to the contrary, then he might be better off financially to hire a lawyer to talk to the judge with a copy of the blood tests.)

Paperwork I have shows the loan was paid off in 1987, but a reconveyance was never received from the lender.
A couple years ago, on my aging parents behalf, I contacted the trustee listed on the note. I reminded him of the situation, provided copies of the paperwork showing the payoff, etc.
The trustee called me back and said that because his company is now bankrupt, his attorney suggested that he NOT sign any reconveyance documents. He said sorry - can't help me.
I would like to ask the trustee again for the reconveyance. If and when he refuses again to reconvey, are there any actions I can take in court to file a request that the reconveyance be released to my parents?
What do I do next? If it is something I can petition the Bankruptcy courts for, I would be happy to.

There is no law that requires your child to have a separate bedroom for overnight visitations. Courts do not typically have a problem with a child sleeping on a couch during an overnight visitation. One thing people forget is direct communication. If the landord touches you despite your verbal protests, you have an action against the landlord. If you either say nothing, or give in to the person's requests, you have consented to contact. Make sure you communicate your desire not to be touched. After the landlord has received that commuication, any subsequent unwanted contact is actionable.
You may be thinking of a "hostile work enviornment" action where consent can be explained away. Is the landlord also your employer?

I have been charged with domestic assault, which I was falsely accused of. My girlfriend has admitted that she lied and also I have proof via a text conversation between her and I that she lied. They have now charged her with falsely reporting a crime, but are still also prosecuting me on my charge. These charges contradict each other. They say they will not drop mine until she pleads guilty. To me this is very unethical the way the are handling it. They don't care about the innocent. They just want a conviction either way. I believe this is coercion by the prosecution and they are not following due process. Is there laws against this, and what can I do about it?

There is no law against what they are doing. The way the prosecution sees it, either she lied to the police and therefore is guilty of falsely reporting a crime, or she was telling the truth and you are guilty of domestic assault.
It may appear that the State is pressuring her to say that you did it. Which is probably what is actually happening. But from the State's point of view, they believe one of you is guilty of a crime (they probably believe it's you that's guilty), and this is the best way for them to at least get one conviction.
You need a criminal defense attorney to help you with this case. I would strongly suggest you sit down with a criminal defense attorney for a free consultation and see what can be done for you.

They paid rent from up thru 15 Nov (15 days of months rent). They actually vacated the property on 19 Oct leaving the house completely empty. You would not be permitted to collect double rent, but you would be permitted to be compensated for damages suffered due to the tenants' early termination.
