Is it legal for a nonprofit organization to offer to open a SIMPLE-IRA to a new employee as part of the compensation package but not to the other employees?



Answer

First of all, if the employee is at-will rather than contract or union, the employer can offer what it wishes too. Second, rules pertaining to a IRA are not the same as a Keough or other matching investment plan. So, yes, it is possible that the offer in this case is proper and legal, subject to facts not provided herein.
