I was pulled over due to a brake light that must have recently gone out. Officer was very cordial and said he'd be back after he ran everything with a warning. He came back with some bad news that he was towing my car and my license was suspended due to a payment default (had absolutely no idea what was going on at this point). This goes back to be being pulled over 8 months prior for having an expired registration. The car is not under my name so I had no idea at the time that the registration was out of date, but anyways thought I paid the fine registration renewal and tow fee all at once. I was never notified by anyone that my license was suspended and my company even passed me during this time for passing the annual driving review in which I thought they looked at your driving record.
But apparently I did not pay the citation and here I am now defending myself for driving on a suspended license, is there anything I can even fight?

If you have a good faith basis to say you did not actually receive notice of suspension, and have credible evidence to support this claim, then this is worth emphasizing at every stage in the process. Other than that, present your case on its specific operative facts; The law is in place to be applied to them and, usually, fairly sort it out.

You didn't mention whether or not your university is private, i.e., one of the numerous for-profit schools, or a public university in California. There's a big difference. I have handled a number of plagiarism cases, both as a university professor and attorney. It's clear that someone at your school has decided that you abetted in the other student's plagiarism. (Frankly, I'm surprised they every found out!) Your argument that you didn't intend to do this and were unaware that your friend would use your work. In a normal, court room situation, the university would have to prove their case and adhere to rules of evidence and procedure. Universities, especially in California, don't feel they need to. In my experience, university administrators are not only ignorante of due process but have contempt for it. That's what you're up against. Since this is an academic matter, the courts will defer to the university--unless there is an egregious violation of due process. Be sure to get as many written witness statements to support your position that you were just a good samaritan and didn't know your work would be appropriated. Also, use ever appeal in the university. Don't miss any deadlines. Demand a hearing, and keep notes on everything said and done.

I would need to see the document, but my gut feeling is that if you signed it and got the benefit of living there then the lease is going to be binding. The guarantor just protects the landlord in case you skip out without paying rent. If the landlord did not get a guarantor, then its the landlord's problem but it does not mean that the lease is invalid.

She named three beneficiaries (one of those is the Executrix) and three beneficiaries. Nearly eight months later no one as seen any payouts from the will. There is considerable speculation that the Executrix is treating herself to the cash that was in the bank and the will does not require that she keep an accounting of any expenditures. She gave the two vehicles that my aunt had to my aunt's two granddaughters, then several days later requested that they pay her for the vehicles. The Executrix is crazy, what can done?

You can sit around and speculate, and post online, and probably watch the estate assets disappear until it is too late, or you can go in the morning and hire a lawyer to look into things.

The fact that there hs been no payout is not necessarily indicative of wrongdoing. Final approval must be received from the federal/state tax authorities and then the account must be confirmed by the clerk or a judge in some states.
I agree with Attorney Ashman. The time you spend posting here is a waste. You need to first contact the probate court in the county/state where your aunt lived at the time of her de3ath and see if an estate was opened. If not, the executrix has no power to do anything. If there is an estate file, make a copy of any relevant documents like the will, inventory and accounting, if any.
Take the will and any other documents to a probate attorney in the county/state where your aunt resided. Pay the attorney for a consult to review the documents. If no estate was opened, then you can compel the executrix to produce and probate the will and apply for letters. There is value in probating an estate as notice to creditors will provide a cutoff point for filing any potential claims. Further, your aunt did have assets in the form of cars.
The rule regarding bank accounts is that any money in the account goes to the other surviving joint account holders at death. That money does not go into the estate and it is possible that if your aunt only had the funds in her bank account, which she shared with the executrix. In such case, then those funds went to the executrix and there is no money in the estate. This could explain why the executrix asked for payment for the cars. The money would be needed to pay estate expenses. Even if there are no debts, there are still costs to probate the estate, pay the executor's commission and pay any estate attorney, if there is one.
If it turns out as I have suggested, then this is not necessarily the executrix's fault. Your aunt should have done better estate planning. However, if the facts are otherwise and it the executrix is not doing her job, then she can be removed. If she is squandering estate assets, then she can be surcharged and stopped. She can also be held personally liable if she has made improper distributions. So that is why you need to see probate atttorney now.

Executors don't become executors until a testator dies and they cannot change a will. A testator can change her will at any timewhile living and that voids earlier wills.

As noted by my esteemed fellow attorneys, executors cannot change a will. If there is an executor of a will, it implies the testator (the person who made the will) is already dead. In that case, the cannot be changed. Only the testator, if he/she is still alive. can change a will. But if the testator is still alive, then there cannot be any executors.
Just because a will names someone as executor does not make it so. To be an executor, the testator has to be dead and depending on how the will is drafted, the probate court has to issue an order which names the executor as officially being in charge.
Finally, if the testator changes a will, assuming the testator has an attorney, it means that the testator made a new will which revoked all prior wills or else the testator properly executed a codicil to the will noting the changes (codicils have to be executed with the same formalities as an initial will, i.e., signed by the testator and witnessed by 2 disinterested people and notarized to be made self-proving)..
If the testator did this herself, then it is unclear whether the changes will take effect or not. Depending on how the changes were made, the testator may have invalidated her will completely.
If the testator is still alive, I would encourage her to have her will and any changes thereto reviewed by an attorney unless an attorney was involved with drafting the will and making any changes.

More recently, courts have begun to analyze the worker's compensation awards by comparing them to disability benefits, rather than personal injury benefits, and have examined the purpose of the payments to determine whether the compensation received by an injured spouse is community or separate property. "We hold that the portion of such an award attributable to disability or pension payments owed during the marriage or medical expenses paid with community funds is community property, but the remainder of the award is the injured spouse's separate property." (Raphael v. Bloomfield (2003) 113 Cal.App.4th 617, 622.

Will contests and hard feelings often stem from children having copies of the will only to find out after Mom's death that she redid her plans.

It is an open question in WI whether or not search warrants are even required before drawing blood from OWI suspects, due to the urgent need to get the sample before the body removes alcohol from it through the natural metabolic process. For many years, the blood was just seized, regardless of whether the suspect consented or warrants were issued, under the legal doctrine of "exigent circumstances." However, the U.S. Supreme Court recently ruled that it would consider the need for warrants on a case by case basis, regardless of the ephemeral nature of suspects' naturally disappearing blood alcohol. Factors such as the availability of a judge to sign a warrant at any given time and location factors which courts now consider, and law enforcement has responded to this case by getting warrants when possible. A minor clerical mistake on a warrant is therefore not likely to have much importance during litigation on a motion to suppress such evidence.
I don't know why several of your friend's samples were thrown out while others were not, but there certainly could be situations where some tests satisfied scientific protocols for forensic evidence while others did not. Factors could include when the blood was drawn relative to when the suspect last drove, whether the suspect was continuing to drink after the accident, how promptly the vials were labeled and refrigerated, etc. Therefore, nobody could even attempt to answer your second question without those details.

I foolishly borrowed 2600.00 from Risecredit.com. After paying back more than 1400.00, I defaulted, as it was getting to hard to keep up with the payments. I had taken out several other loans that were from Tribal payday lenders not licensed in my state. I found out those were illegal, and defaulted on those prior to defaulting on Risecredit.
Rise only waited 3 months before selling my loan to a collection agency with an unscrupulous reputation (national credit adjusters). They are now starting to come after me. However, I think this loan may not be legal either, for two reasons.
Although Rise has a license to do business in my state, they are a tribal entity hiding behind a license that was taken over from a previous company (payday one). Also, they are charging an arm and a leg in interest, so I think they may be breaking the usury laws.
How can I find out for sure whether this loan is a legal one?

In my opinion, you should be able to charge and collect for your mileage for miles driven in the pursuit of tasks on behalf of the estate. Ahhh, now there's the rub, finding the short.
The first thing you have to do is isolate the wires leading to the horn itself. You'll then have to trace the wires back to the switch which is located on the steering wheel. You'll also have a wire which travels to the power source. (battery) The circuit is simple enough; unfortunately your wires are likely to be bundled with fifty other wires.
Look for clues: 1) When the horn activates, is it a long solid blast which suggests that the wires may be pressed firmly against a ground?
2) Or is it a series of halting toots which occurs while going over a rough patch of road?
It would help if you have a multimeter set to detect low voltage. Place the negative lead on a good contact point on the engine and run the positive lead along the wires and look for a spike in voltage. If you find one then that could be the source of your problem. Isolate the area and insulate with electrical tape.
Of course, you could get lucky and find a break in the wire where is has rubbed against the car body or engine and left a burn mark.
These are some general remarks to help you get started. Take my advice, if you haven't managed to find it in the first hour, take it to your dealer. It may be worth the money to you to avoid the aggravation.

Aunt needs a will. If uncle is dead, then uncle's property passed to his wife. She can leave the property to anyone but you are not next of kin. You have no blood relationship to the aunt. If your uncle is dead then how can your aunt have a husband? Has she re-married? Any of aunt's brother-in-laws (brothers of husband) have no claim on her estate either as there is no blood-relationship.
If aunt dies without a will and without a surviving spouse and children or lineal descendants (grandchildren, great grandchildren and so forth) then her estate will go to her parents if they are living. If there are no siblings, then the laws will look to her grandparent's to see what other children they had and if they had any children. At some point, the relationship becomes too distant and state law provides for a cutoff point in which case all of your aunt's assets would escheat to the state.
Your aunt needs to think about where she wants her property to go if she dies and if she chooses to benefit her husband's nieces and nephews then she absolutely needs to make a will. She needs to consult a probate attorney who practices in the county/state where she lives.

In dissolution, is there any responsibility enhance assets?
example: I painted a picture and there were 10,000 prints made. My partner in the LLC wants me to number and sign them for dissolution thus significantly enhancing them. He is the one who wants to dissolve the LLC, not me.
It has been in existence less than 2 years.

Alabama law permits the dissolution/termination of a business entity once the purpose of the formation of that entity has been accomplished. Was this painting and reproductions the sole purpose of the LLC?
Otherwise, Alabama law also allows each partner to sue for division and termination of an entity if the partners have gotten to the point of deadlock. I would suggest keeping lines of communication open and that you ask your partner to put his reasons for a termination in writing to you and let him know that you are undecided at this time but not opposed to discussions along these lines.
Did you give the LLC authority to duplicate the painting? has your business partner put up any monies to accomplish such endeavor if this was the original intentions for the LLC's formation?
What does your written agreement "say" as to your dissolution rights, etc.? Who is the named manager of the company? Who controls the prints and bank account? are two signatures required?

Why would it be. As long as you pick up the children (which could be an issue since you moved) there should be no problem. I would have to see what you signed. Was it approved by the court. If not, you may need to do that in order to make it enforceable.

I am supposed to pay $5000.00 within two weeks b/c I owe child support that I never received any papers on stating that I had to pay anything at this time. I am still married to her and she turned in papers to the child support based on the income I made when I owned my own business. Now I make $8.00 an hour and have to come up with this money immediately. Is this legal? Can I make payments weekly for the back-support I owe or is this all based on the judges decision?

With this much money at stake, you may want to consult an attorney and see if there might be a procedural error that can allow your to challenge the previous order, though there is a slim chance of it.
You need to start making payments right away - as much as you can - to show good faith. Then ask the prosecutor and judge for leniency.

I have tenants who signed a year lease for an apartement beginning on 5/1/13 & ending on 4/30/14. Upon moving in, they paid first & last, and no security deposit. They owe $150.00 in back rent which was due 8/1/13 & on 9/3 in a phone conversation, they stated they are moving at the end of the month (9/30/13). After the call, I drafted a letter stating they are in violation of their lease, still had a balance owed from August, as well as in the lease, it states they are to reimburse me for water & sewer, so they owe that as well.
I drove by yesterday and it appears they are still living there. In an attempt to see if they are waiting for the weekend to move, I've called several times, but no answer. My thought is to deliver a 7 day notice since they are truely late on their August rent. Is that my best course of action? Is there another document/form/process I should be using?

Landlord Tenant law is very technical and by design contains safeguards to prolong tenancy. Your questions are understandable and reasonable, however, there is really no way to even generally comment on the course of action without reviewing the lease that exists.

That would depend on the provisions of your father's trust. It must name them specifically as a beneficiary or it must state that your share goes to your children if you predecease him.
