If a person was convicted in a federal court by a jury and the judge throws out the conviction can the prosecuting attorney have it looked at by a district court to have the conviction reinstated?
Answer
The district attorney can sometimes appeal to the appeals court if he does not like the district court judge's ruling. More often, the district attorney will refile the charges or retry the case. Howeever, it depends on the stage of the case and why it was dismissed.
