Question

My mother just passed away. She lived in Cherokee County, Oklahoma, and had a very small personal estate. She left a will and I am named executor. Must I probate her estate, and if so, how do I proceed? Thank you!

Answer

You are not required, even though you have been nominated Personal Representative (Executor) to initiate probate or to serve as PR. However, depending upon the type of property your mother owned, how it is titled, and her debts, it might be advisable to probate her estate. I strongly encourage you to review her estate with an experienced probate attorney before making any decision.
