The proper procedure when spouses decide to end a marriage is for the spouses to enter into an agreement which expressly waives any right to inherit or administer the estate of the other. The spouses then should each have a new will done by an attorney which disinherits the other spouse. In that way, if someone dies prior to entry of a divorce decree, the survivor will not be able to inherit. However, clients don't always think to do this. If nothing was done, then the survivor would be able to inherit under a will or under the intestacy laws unless the state had a statute providing for the forfeiture of inheritance like NC does.

You don't indicate any relevant facts so an attorney cannot give any specific advice. Which spouse died? Where did he or she live at the time of death? When did he/she die? Is an estate going to be probated? Did the dead spouse have a will? If so, what did it say about the surviving spouse inheriting assets? Was any kind of a pre- or post-marital agreement created and what did it say about death/inheritance? Had an equitable distribution order been entered? What probate and non-probate assets were owned and how were they titled?

The rules (assuming the estate for the dead spouse is in NC) are that death abates a divorce action but it does not necessarily end any equitable distribution actions. If there is no forfeiture statute or else it does not apply, then the surviving spouse may be able to inherit. However, the death of one spouse does not end a right to equitable distribution. In NC, these claims survive death and a comparable law may be in the other state. If so, then a claim can be filed so that the assets will be divided between the surviving spouse and dead spouse's estate. In equitable distribution, the court will seek to classify assets as being marital, separate or divisible, value the assets and distribute the assets between the estate of the deceased and the surviving spouse.

If the dead spouse lived in another state, you can try consulting a probate attorney who practices in the county where the deceased spouse lived prior to death or you can try re-posting your question with the relevant details and directing it to a probate attorney who practices where the deceased spouse lived.

I can't speak for all car manufacturers but I do know that it takes approximately 4 months for a vehicle to be built and delivered to the dealership. It doesn't take that long to build the vehicle but manufacturers work on a "first-in-first-out" ordering and delivery system which means that your order is placed on a "build list" so other orders must be filled before your vehicle will start being built. That time may be longer depending on demand for that specific vehicle. For example, the wait time for a hybrid (gas/electric) vehicle may be longer if gas prices are high and there is a high demand for them. This would mean that once you place your order it will be placed at the back of the line behind a higher than normal amount of orders, thus the longer wait time. Technically no. It is not legal to change pay after work is performed. Simply announcing that pay will change without saying what it will change to does not work. You have to pay an employee as agreed until you tell them what their new pay will be, and the change can only be prospective, not retroactive. They must pay according to the old commission schedule until 1/20/12, then the "bad" new structure for 1/20 until the new structure is provided to you, and the new structure once it is provided to you. Your signature is not required for the commission structures to take effect.

I don't know why you don't proceed with the divorce. But if you will not, then you need a marital separation/settlement agreement which specifically provides that you and your wife are waiving any rights to administer the estate of the other, any rights of inheritance or any rights to an elective share of the estate. After you get the marital settlement agreement, you then need to make a new will which specifically provides that you are disinheriting your spouse as per your marital settlement agreement.

Your wife was smart - with a reverse mortgage, the heirs will have to pay back the bank if they want to keep or sell the home after your wife dies. Depending on its value, it may be smarter just to let the bank have it. So, even though you would be entitled to a share of her estate, there may be nothing for you to get if she does not own much and set it up so that her son will get any money.

However, if you don't have an agreement and something happens to you, your wife could possibly try to claim an elective share of your property when you die. Although there is a statute in NC on abandonment, its better not to rely on that and do what I have suggested. Please go and see a family law attorney about the divorce/marital agreement and then get a new will. The price you pay now will be worth it if it avoids the possibility of your wife getting a portion of your estate if something unfortunate would happen to you.

It could be any number of things, but here's what to check...

Make sure the radiator is full of coolant (with the engine off and ice cold, facing slightly uphill)

If you need to add coolant start the car (with radiator cap removed) and add coolant while its running directly to the radiator. Once the radiator is full replace the cap then add coolant to the reservoir.

If coolant is not an issue, then make sure the fan is coming on when the car is trying to overheat...a dead fan or bad solenoid to make the fan run is very common on newer cars, older cars used a directly attached fan that always ran with the engine on.

Next thing to check is the termostat, if the car starts to overheat and the top radiator hose is hot and obviously coolant isn't circulating through it then a bad t-stat is to blame.

It could also be a bad water pump; however, under normal circumstances it would leak a small amount of water from a "weep hole", the location of the water pump varies slightly with vehicle.

Lastly you could have a blockage in the radiator requiring repair from a reputable shop or replacement (which is usually cheaper, if you're the one doing it).

Obviously no one would be foolish enough to buy a business without having both a lawyer and a CPA review the contract, and searching basic records as to things like law suits. So that means you have a lawyer already, who for a few hundred dollars, has already given you the answer and information you need. So pick up the phone and call your lawyer and you should have your answer.

On the outside chance that you did something completely foolish, and actually signed paperwork to buy a business with no lawyer, you may have walked into some very expensive litigation, as it is unlikely you can just wait on the suit you could have found out in advance about, and you also have to deal with your coworker.

(To be honest, if you were foolish enough to not have a lawyer, and the co-worker buys the business, be VERY thankful, as you probably dodged a bullet).

The moral: you do not EVER sign a contract without a lawyer, and you do NOT ever sign a contract with financial implications without a lawyer and a CPA.

Its not a breach of contract...it may be that they are attempting to manipulate or otherwise mis-read the contract. You should send them a letter explaining why you do not owe anything. I have recently received a lateral reassignment to another federal facility that is located approximately 1700 miles away from my current facility. The manager at the gaining facility has indicated to me an individual has raised false claims against me just prior to the formal offer being made to me. I have since received and accepted the formal offer to relocate. However, I have inquired to my current manager and other fellow employees regarding knowledge of the allegations made against me. Do you know how much you paid for that debt negotiation "service"? You might be shocked.

So, even if you could remove your wife from your health insurance coverage, you should not.

Suggest that you immediately consult an attorney, in person, to review grounds for divorce and temporary restraining orders, to limit your financial exposure.

In the interim, you can and probably should, close all of your joint and separate accounts, including but not limited to banks, credit cards, etc.; and change your bank/s, credit cards company etc., to protect yourself from your wife's proliferate spending, from funds needed to maintain your home.

This is a tough one to predict. If you secure substitution housing, the landlord may be responsible for the extra expense. If the lease says 11/5, na dhe cannto delvier possion unitl 11/28, he may have to reimburse you for a hotel and storage unit for that period. If the landlord does not agree to reimburse for that, then you can probably cancel the lease prior to moving in, and get all your money back. But, you may have to sue to get it.

The short answer is probably yes.

Death of a tenant does not terminate a lease or the duty to pay rent. And the landlord cannot re-rent the property until your father's things are removed from the premises.

I don't do landlord tenant law very much and while I checked the statutes (there is nothing there) there may be something in the caselaw which would shed light on this. I suggest that the personal representative of your father's estate talk this over with a probate attorney for the estate.

When would the lease be at an end? Is the landlord willing to forego the rest of the rent under the lease? Or will the landlord allow the lease to terminate and accept 1-2 months' rent as damages? If so, then the agreement needs to be in writing.

If not, then the personal representative should get your father's possessions out of the unit as quickly as possible. Clean the unit and take pictures before the keys are surrendered to the landlord. Do a move out inspection and note any problems or lack of same on the move out sheet and get a copy. An estate generally should be probated if your father had probate assets. Notice to any creditors, including the landlord, would then be given. The landlord and any other creditors would then have the opportunity to file a claim for any unpaid rent or damages. If none is filed, then there is no money owed.

Does the landlord have a security deposit? The deposit is for any damage to the property. If there is no damage (which is why you do a move out inspection after you clean the property and fix any damage) and there is no unpaid rent, the landlord will return the security deposit. In this case the funds would be paid to the personal representative and distributed as part of the estate.

If there are no assets that would justify probate here, and if the property will be left in otherwise good condition, maybe the landlord will agree to keep the security deposit in lieu of any rent payments for January. Again, I would get this all in writing.

This is a very confusing area of law so even I am reluctant to answer because there always seems to be exceptions and exception to exceptions so take this for what it's worth. You are not "convicted" under Florida law and therefore under Florida law, you should be able to possess. That means you should be able to apply to buy and be able to possess a firearm. For Federal law purposes, however, you can't possess a firearm, if you pled guilty (as opposed to no contest), then you should still be able to possess a firearm. A no contest plea on this charge will mean that you should be able to possess a firearm under Federal law. Furthermore, if there was a separate injunction placed against you, then for that reason alone, you can't possess a firearm unless and until the injunction is lifted.
